Mohammed had sued for divorce on the accounts of constant fight, violence and threat to life by the wife.
The plaintiff told the court his wife had made his life miserable since he got married to her. He, as such, prayed the court to separate them.
Anuoluwapo admitted to claim stating that her husband was irresponsible and indifferent to her welfare and that of their only child. She added that he was indebted to her to the sum of N5, 000 and has refused to pay her.
Giving his judgment, the court president, Chief Ademola Odunade observed there was no more love between the couple.
Ruling, Odunade dissolved their union and gave custody of their child to the defendant while the plaintiff was asked to give N4, 000 per month through the court as their child’s feeding allowance.
He was also mandated to be responsible for his education, health care and general welfare.
Giving his evidence, Mohammed stated that:”My lord, my life has been miserable since I got married to my wife because she’s troublesome and has constantly threatened to pour acid on me or kill me with a dangerous object. I know she will carry out her threat one day if I don’t act fast.
“She comes to destroy items meant for sale in my shop. She doesn’t stop at this, but also fight my customers most of whom have now stopped patronising me.
“She once pushed and injured a customer for making an attempt at mediating in our differences. This man hit his face on an iron surface and this got swollen.
“My lord, she has caused me enough embarrassment, I’m done with her.”
Anuoluwapo admitted to claim.
“My lord, I went to his shop to demand for the payment of the N5,000 he borrowed from me and has refused to pay back.
“I’m not troublesome and never threatened to pour acid on him. He was lying, “she said.
“When we met, he never told me he was married and that he has five children. Midway into our friendship, he impregnated me and asked that I aborted it by this time the pregnancy was five months old and I refused.
He neglected me throughout the time I was carrying his baby and refused to give me money for pre-natal and post-natal care.
“His family members also didn’t show up or made any attempt at seeing my parents. It was his elder sister who came to my aid by giving me money to buy baby items, “she added.
“My lord, my father in-law sent me packing immediately I put to bed while we held our baby’s naming ceremony in my husband’s friend’s house. I kept moving from place to place with the baby because we didn’t have a place to put our head.
“He didn’t spend a dime on the baby for a whole year. I enrolled our child in school and had paid N20, 000 thus far on his education while he paid only N5, 000 and this was after much pleading from me.
“I visited his shop because he owes me N5, 000 and has refused to pay back.
“I agree that this honourable court separate us. I further pray the court to give me custody of our child in order to give him adequate care, “she told the court.
