A couple, Iyabo Adegoke and Yinka Adegoke recently appeared before Oja Oba/ Mapo Court C Customary Court, Mapo, Ibadan, Oyo State on the account of irresponsibility and battery by the latter.
Iyabo who approached the court complained that her husband was troublesome and in the habit of embarrassing and beating her in the public.
The plaintiff added that the defendant always called their children bastard anytime they had a brawl.
Iyabo, therefore prayed the court to dissolve their union and award custody of their children to the defendant.
Yinka agreed that their marriage be dissolved but refused that the custody of their children be awarded him because according to him, he travels a lot.
The defendant who admitted to beating his wife stated that she was stubborn and unfaithful to him.
He added that his wife attended parties and sometimes travelled out of town without his consent.
Yinka added that she was a liar and in the habit of collecting more money from him than the stipulated amount as their children’s fee.
“My lord, my husband has humiliated me enough. He not only beats me at home, but goes as far as disgracing me in public, ”Iyabo told the court.
“Yinka once trailed me to my parents house late in the night after I left home due to a misunderstanding between us.
“My husband not showing respect for my parents descended on me with heavy blows in their presence and almost killed me.
“Yinka wasn’t like this when we got married. He was a peaceful and loving husband, but he suddenly changed and turned into a monster, thus making life difficult for me and our marriage hell. I find it difficult to relate with him these days.
“My husband has failed to give our children adequate care. He doesn’t treat them well.
“Any time we had a misunderstanding, my husband would vent his anger on our children. He would shout on them and use derogating words at them. He often called them bastard at moments like this.
“My lord, I don’t wish to stay married to my husband any longer. I’ve tolerated him enough.
“I entreat this honourable court to end our union and grant my husband custody of our children, ”the plaintiff stated.
“I can’t have custody of our children because I travel a lot, which is the reason I put them in the boarding school, ”Yinka stated while giving his testimony.
“My lord, I agree that the court dissolve the union between me and my wife because she is a dangerous person to live with.
“Iyabo is a liar and a dupe. She lies about our children’s school fees.
“My wife would add to their fee and pocket the extra money. She has been doing this for long before the cat was let out of the bag.
“My lord, Iyabo had the guts to change our children’s school without consulting me. Till date, she has failed to give me any reasonable explanation for taking such a step.
“My wife is involved in extra marital affairs. She calls off my bluff and leaves home without my consent. Iyabo sometimes travel out of town with her lovers to attend parties.
“I have warned her times without number against this but she has refused to change which gives reason for my beating her.
“My wife suddenly took to going through my phone. She would read my SMS and WhatsApp messages, but I always tell her she would find it hard to point an accusing finger at me because I’m decent, ”the defendant stated.
Giving his judgment after he had heard both parties, the court president, Chief Ademola Odunade stated that it was obvious that the union between both parties had broken down irretrievably.
Ruling, Odunade dissolved their wedlock and granted the plaintiff custody of their children.
The defendant was asked to be responsible for their upkeep with priority given to their education and health care.
Both were advised to maintain peace.
