UPDATE: Appeal Court affirms Fubara as Rivers Gov

Appeal Court in Lagos has affirmed the victory of Rivers State governor, Siminalayi Fubara and dismissed petitions by other opposition candidates as lacking merit. 

The Court of Appeal held in a unanimous decision that Tonye Cole of All Progressives Congress (APC), Beatrice Itubo of the Labour Party (LP), Innocent Ekwu of the Allied People’s Movement (APM), and Lulu Briggs Dumo of the Accord Party failed to prove the allegation of non-compliance with the Electoral Act.

The APC candidate, Tonye-Cole who was present in the courtroom on Tuesday, 28th November, 2023 wanted the court to direct the Independent National Electoral Commission (INEC) to declare him the winner of the March governorship election in Rivers.

Recall that the Rivers State Governorship Election Petition Tribunal had in October affirmed Fubara’s victory as governor of the state stating that the petition questioning Fubara’s victory had been withdrawn by Cole’s Party, APC and other opposition parties like the Labour Party and the Allied Peoples Movement (APM) as lacking merit. 

Cole, not satisfied by the ruling of the Tribunal, approached the Appeal Court which equally dismissed his petition, Tuesday, 28th November, 2023.
