Kabiru alleged that his wife was quarrelsome and adulterous in nature. He, therefore, prayed the court to separate them and grant him custody of their three children.
He also prayed the court to restrain her from coming to fight him in his house or work place if his prayer was granted.
Giving his evidence, the plaintiff told the court that, “My lord, I regret the day I got married to my wife. Her presence in my life has brought nothing but unrest, shame and embarrassment to me.
“If I had known, I wouldn’t have gotten married to a second wife. My first wife is calm and responsible, but my second wife is a devil in disguise.
“She’s troublesome and seeks every opportunity to fight. She nags and complains over every issue while she’s never satisfied with whatever I do for her. I go the extra mile in making her happy, but she views all I do as nothing.
“Rather than dot on me, all she does is to shout, fight and rain curses on me, Raimi told the court.
“She has woefully failed as a wife and mother. She cooks for the home whenever it pleases her and will leave our children to sort out themselves.
“I have gone to bed with an empty stomach on a number of occasions and she saw nothing wrong in this.
“She’s not domesticated and leaves the home constantly dirty and untidy. She’s fond of stacking used plates in the kitchen and these could be there for days.
“She’s also in the habit of piling up dirty clothes thus leaving the whole house dirty and smelling. All she does is to dress up, paint her face and leave the home to carry out her adulterous acts.
“My lord, my wife is unfaithful to me. She’s having an affair with someone in the neighbourhood who she constantly has sex with. Her promiscuous ways is no more a secret in the neighbourhood. Many times, this is thrown into my face. I walk in our area head bowed because of her shameful acts, he added.
“My first wife seeing that my wardrobe was nearly empty since her rival has failed to do the washing of my clothes took up the responsibility.
“She would wash and iron my clothes and lay them out properly in my wardrobe.
“Bilikisu came home on one of the occasions her rival was watching my clothes and went mad. She accused my first wife of trying to win back my heart and turned the whole house upside down.
“She warned me never to ask her for sex again since according to her, I have gone back to be sleeping with my first wife.
“My lord, since she has vowed never to have sex with me again, I decided to boost the intimacy between my first wife and I, “the defendant stated.
“My lord, the major reason I have come to court is that she aborted a pregnancy which was not mine. She bled heavily after the abortion and almost died, ”the plaintiff said.
Bilikisu did not accede to claim.
“My husband is jealous and if care is not taken, he will die of hypertension. My lord, he lied that I’m adulterous. The person he accused me of having an affair with is his friend and a God-sent. He has been supportive and his counsels have helped sustained my marriage. Any time he sees us together, he would wait till I get home and rake. He was always accusing me of sleeping with his friend. I have always asked him for a proof to support his claim but he has failed to produce one, “she told the court.
“It is true I told him never to ask me for sex again. I said so because he’s a womaniser. I decided to stop sleeping with him because I don’t want to contract STDs, “she said.
“There was never a time I aborted a pregnancy be it his or another person. I bled as a result of the injection I was given when I went for family planning, “she concluded.
After he had listened to both parties, the court president, Chief Ademola Odunade observed that there was no more love between them
Giving his judgment, he dissolved their union and gave custody of their first two children to the plaintiff and the third to the defendant.
The plaintiff was ordered to give the defendant N3, 000 to pack her belongings from his home. He was further mandated to pay the sum of N4, 000 monthly through the court as the child’s feeding allowance and be responsible for her education and healthcare.
