Nurudeen had dragged his wife to court on the accounts that she was fetish and constantly denied him his conjugal rites. He thus prayed the court to put an end to their relationship and grant him custody of their daughter who was in her care.
The defendant refuted the claims stating that the plaintiff was irresponsible and fond of stealing her money adding that he forced her into marriage through diabolic means.
After he had listened to both parties, the court president, Chief Ademola Odunade observed that their marriage had broken down irretrievably.
Giving his judgment, he dissolved their union and granted custody of the two children in the marriage to the plaintiff.
The plaintiff giving his evidence stated that:”My wife complained to me that her business was experiencing a down turn. As an alfa, I told her there were some spiritual rites I usually carry out for people with such problems to boost their sales but she declined claiming that it was fetish.
“I later came across black soap and some other fetish things in her possession which I pointed out to her were fetish but she brushed the issue aside. I again came across a five-liter keg of water which she kept under her bed. When I demanded for an explanation, she raised her voice at me and walked out on me.
“I reported her to an elderly neighbour who tried to mediate. My wife got infuriated, stood up and tried to push me aside where I was standing at the door. I pushed her back and she fell and hit her face on a sharp object which left a cut on her face.
“A few days later, I lost my twin brother and went to commiserate with his family. On returning home, I met an empty house; she had packed all her belongings and left with our two children, “he said.
“I didn’t set my eyes on her and our children until a year and a half later after I was informed of where she was living. She had taken our children to her country, Togo by then.
“I reported her to the police who helped in bringing the children back to Nigeria. By the time they returned, they could only communicate in Togolese language.
“Our differences were resolved and we rented a new apartment and moved in. I rented a shop for her and bought her a deep freezer to sell soft drinks, but to my surprise, a few months later, she started telling those who cared to listen that I wasn’t taking care of her.
“She stopped having sex with me before she left my house the first time and still denied me my conjugal rite when we were reconciled. She left our room and started sleeping in the sitting room.

“I came across a medical document in her possession which indicated she had gone for family planning without my knowledge or consent.
“I did my best in making her see why it was essential that we lived in harmony but she refused to listen to me and turned worse.
“I got fed up with her one day and asked her to leave. She left again with both kids but the male was retrieved from her through the help of the police. My lord, aside divorcing her, I want the female child also in my care, “he stated.
“My lord, I can’t explain till date how I went into marriage with my husband. I make bold to say that he married me through diabolic means. I was already carrying his pregnancy by the time I came back to myself, “Folake told the court.
“After he married me, he married two other wives that same year. They have both left him and took their children along.
“He’s an irresponsible human being; he passed to me his responsibility of taking care of our children and home. He would leave home by 7:00am and return by 11:00pm without leaving feeding allowance.
“The first time I was pregnant, I paid for all the medical examinations I went for and sold heads and legs of chicken for survival.
Forty days after I had our baby, he beat me blue-black over a trivial matter.
“I stopped having sex with him when he denied being responsible for my second pregnancy. I told him he couldn’t have sex with me while carrying another man’s pregnancy. But when I put to bed, he threw a party.
“I sold cooked beans and yam to take care of the family during pregnancy and after child birth, “the defendant added.
“My lord, my husband is a thief. He’s fond of ransacking my belongings and stealing my money. I once caught him searching the bag I kept my proceeds for the day and when I challenged him, he lied that he was looking for the bag of gari which we normally keep in the kitchen.
“I’m not fetish and don’t engage in diabolic things. I’m a Christian and as such can’t pray in the Islamic way which is the reason I go to the mountain to pray. There, we were asked to bring kegs of water and prayers were offered on them. I use the water for prayers, “she concluded.
