The wedlock between a couple, Segun Omoniyi and Remi Omoniyi was recently dissolved by Oja Oba/ Mapo Court C Customary Court, Mapo, Ibadan, Oyo State.
Segun, who approached the court alleged that his wife was troublesome and always fighting him and their neighbours.
The plaintiff explained that his family has been moving from one house to another because his wife never allowed peace to reign in every compound they lived in.
He added that Remi was in the habit of raining curses on him and that this was in addition to being violent.
According to the plaintiff, the defendant was in the habit of attacking him with dangerous objects any time they fought.
Segun also stated that his wife was adulterous. He explained that she constantly denied him sex and that any time they made love, Remi would lie stiff and cold in the bed like a corpse thus frustrating him.
The plaintiff told the court the defendant on the other hand made herself available to other men.
Segun stated that he found in Remi’s possession, some documents which indicated that she went for family planning without consulting him or getting his consent.
He added that he also once came across a few dollar notes and some pictures she took with another man hidden under their bed.
According to the plaintiff, a promiscuous woman like Remi can kill.
He, therefore, appealed to the court to stop their marriage before his wife cut short his life.
The defendant agreed that their marriage be dissolved but prayed the court to grant her custody of their children whom she stated the plaintiff failed to take care of.
Remi said she had planned to leave Segun after they had their first child, but that her siblings prevailed on her to stay and endure the hardship she was encountering in her marriage.
The defendant explained that her husband failed to be up to his task as the breadwinner in their home.
According to Remi, it was her sister who provided her a source of livelihood by buying her a grinding machine, adding that she also bought their children clothes.
Remi stated that her husband was always seeking every opportunity to beat her.
The defendant said the plaintiff would descend on her with heavy punches and would not leave her until she bled.
Segun giving his evidence said: “My lord, I hold my wife responsible for the slow progress I’m making in life because she never stops cursing me.
“My wife is troublesome and unruly. She fights like a jackal. Remi and I are always having a brawl because she loves to have her way.
“Remi is violent and often attacks me with dangerous object, when fighting me. The last time we fought, she attempted to stab me with broken bottles, but I took to my heels.
“We keep moving from one house to another because our belongings were always thrown out by our landlords after getting fed up with Remi’s hostile nature.
“My wife would fight our landlord to a standstill and later pounce on our neighbours.
“Remi humiliates me as a result of her disgraceful behaviour,” the plaintiff stated.
“My lord, my wife starves me of sex. Remi refused that we make love but readily satisfies her lovers.
“Any time I forced myself on her, she would lay stiff and cold on the bed like a corpse thus refusing to satisfy me.
“I once returned from work earlier than scheduled and I was shocked because of what I saw.
“Remi had a towel wrapped round her and she was sweating. She had obviously just finished making love to her lover who must have dashed out through the back door at my return or was hiding somewhere.
“My lord, my wife treats me with contempt. Remi takes decisions in the home without consulting me. We often fight over this but she refused to change.
“I once came across a document which indicated she went for family planning.
“At another time, l found under our mattress, a picture she took with one of her lovers and this in addition to a few dollar notes, all kept in an envelope.
“Remi’s explanations on these discoveries were unconvincing.
“My lord, I no longer want to stay under the same roof with my wife. I hate to have anything to do with her. I, therefore, pray that you dissolve our union, “the plaintiff said.
Remi in her response said, “My lord, I’m ready to be separated from my husband. But I pray this honourable court to grant me custody of our children. My husband is irresponsible and can’t take care of them.
“I would have left Segun after we had our first child but my family members admonished me to stay with him and endure the hardship I was going through.
“My husband didn’t know how I fed and clothed our children. Neither is he interested in their education.
“I took up a job as an attendant in a beer parlour to feed our children, but he seized our cooking utensils because I refused to serve him food I prepared from my hard earned money.
“He also once hid our mattress and made me sleep on bare floor.
“Our first child once took ill in the middle of the night and I had to call to neighbours for help. My lord, while our neighbours ran helter skelter to administer to him the first aid, Segun was snoring in bed, “she said.
Remi further stated that, “My husband is a brute. I feel sore always because he is always descending on me with punches.
“My elder sister took up my husband’s responsibility by clothing our children and also bought me a grinding machine to make a living.
“Rather than show gratitude, all my husband did was to complain, ”she concluded.
Ruling after he had heard both parties, the court president, Chief Ademola Odunade dissolved their union and granted custody of their children to the plaintiff.
