
THE Court of Appeal sitting in Ado-Ekiti, Ekiti State, has upheld the election of Mrs Fatimat Raji Rasaki, representing Ekiti Central District in the Senate.
The appeal court, in a judgment on Wednesday, dismissed an appeal brought by Mr Lateef Ajijola, who contested the primaries with Mrs Raji Rasaki for the party’s ticket.
Ajijola had gone to court to challenge the candidacy of Senator Raji Rasaki and had claimed that he won the majority of the valid votes cast at the primaries.
He claimed that having allegedly won the majority of the lawful votes, he should have been fielded by the party as the candidate in the election.
But the three-man panel led by Justice Ahmad Belgore ruled that Senator Raji Rasaki was the validly nominated candidate of the Peoples Democratic Party (PDP) for the senatorial district in the April 11, 2015, National Assembly elections.
The court held that Ajijola’s appeal was dismissed as it was “statute-barred,” saying it had been filed outside the time allowed by law.
