A woman, Hawawu has dragged her husband, Abdulraheem before Grade A Customary Court, Mapo, Ibadan, Oyo State on the accounts of irresponsibility, noncooperation and support, domestic violence and threat to life.
She, therefore, begged the court to end their relationship.
Hawawu, in her divorce suit, said that Abdulraheem refused that they both cooperate in running a peaceful home.
She stated that her husband was tight-fisted and neglected her and their children.
According to her, he refused to support their academic pursuit and thus left her to pay their children’s fees.
She also stated that he was full of violence and always hit her with dangerous objects any time they fought.
The plaintiff, therefore, prayed that their wedlock be dissolved.
She further pleaded for custody of their children and demanded N100,000 monthly as feeding allowance.
She also requested that her husband be responsible for their children’s medical care and provide a roof over their children’s head.
Hawawu further requested an order restraining her husband from coming to her apartment to threaten her.
The plaintiff again demanded an award of N100,000 against the defendant as the cost of litigation and miscellaneous in the case.
Abdulraheem refused to make an appearance in court despite being served court summonses.
Hawawu, giving her testimony, said, “l moved in with my husband after we met and dated for a few months.
“We never held a wedding ceremony, and he did not pay my bride price.
“My husband refused that we cooperated on issues concerning the home.
“He took decisions all alone and never weighed the consequences.
“He is also tight-fisted and irresponsible.
“He dodged his responsibilities towards me and our children because he did not like to spend his money.
“I pay our children’s school fees even though my husband is alive, hale and hearty.
“He would end up fighting me any time I complained about his inadequacies.
“He would hit and hurt me with dangerous objects when beating me.
“My lord, my husband will kill me if I remain under his roof.
“I pray that you end our marriage and grant me custody of our children.
“I plead that the court make my husband responsible for our children’s
feeding and education.
“I further request for an order restraining him from threatening and interfering with my private life.
“My lord, I hereby demand the sum of N100,000 from my husband as the cost of litigation in the case.”
The court president, Mrs S.M Akintayo, giving her judgment, stated that Abdulraheem was given sufficient opportunity and time to defend himself in the suit, but that he refused to come to court.
Akintayo stated that there was no marriage to be dissolved because no customary wedding was held between the two.
She added that the defendant did not pay the plaintiff’ bride price.
Akintayo granted the plaintiff custody of their children while she ordered the defendant to be responsible for their children’s upkeep, giving feeding, education, and health care a priority.
She further granted an order restraining the defendant from threatening and interfering with the plaintiff’s private life.
Akintayo awarded the sum of ofN30, 000 as cost in the suit against the defendant as adduced by the plaintiff that she paid her legal representative.
