A man, Yunisa Abdullahi has approached Grade A Customary Court, Oja Oba, Mapo, Ibadan, praying that it stopped his nine-year-old union with his wife, Zainab Abdullahi, who he alleged was troublesome and in the habit of fighting him all the time.
He also stated that his wife always accused him of wanting to kill her.
Yunisa also accused Zainab of engaging in immoral act in the presence of their nine years old child, which she now practiced.
According to Yunisa, Zainab deserted him after he set her up in a lucrative business and also denied him access to their child.
The plaintiff pleaded with the court if his prayer was answered to grant him custody of their only child so that he can give her a good upbringing.
Zainab denied the allegations brought against her, but agreed to divorce.
She also refused that her husband had custody of their child stating that he neglected his responsibility towards her.
The defendant told the court that her husband was a womaniser and that he married his seventh wife while their child was just three months old.
Zainab added that he was a brute, Yinusa always beat her any time she turned down his request for money.
Zainab further stated that she once reported Yinusa to the police after he beat her blue black for refusing to give him money.
According to her, she moved out of his house when she could no longer bear his maltreatment.
Yunisa in his evidence said, “I met my wife in 2014 and we went into a relationship.
“I impregnated her while we were courting and she moved into my house.
“Zainab to my surprise, went ahead to terminate the pregnancy without my knowledge.
“This caused a strain in our relationship, but we later made up.
“Her second pregnancy produced a female child who happens to be the only child in our marriage.
“My lord, the more I tried to make our marriage work, the more Zainab frustrated me, which resulted in the two of us drifting apart.
“My wife is troublesome and was always seeking every opportunity to fight me.
“I hated and feared to return home after work, because I was sure my wife was going to raise a trivial issue, which she would ensure ended in a brawl.
“Our neighbours knew no peace because of my wife’s shameful behaviour. We were always waking them up late in the night with our fight.
“Zainab dented my image in our compound and neighbourhood because she never ceased to accuse me of wanting to kill her, but she failed to prove her claim.
“I overlooked my wife’s shortcomings and went ahead to set her up in a business which was quite lucrative.
“Zainab’s lot changed and she had said all she wanted.
“I returned from work one day and discovered that she had packed her belongings and moved out of my house.
“Zainab through her indecent conduct exposes our child to immorality.
“I requested that our child pay me visits some times, but was surprised to notice a particular misconduct in her the few times she came.
“My lord, I caught our daughter removed her pant and that of her step sister and she went on to lie on her step sister.
“I caught them in this act thrice and I called my wife’s attention to it.
“Zainab stopped our daughter from paying me visits after this and denied me access to our daughter.
“She keeps changing her school because she is always moving from one house to another.
“My lord, it is obvious that there is no future in my relationship with Zainab.
“I, therefore, appeal to this honourable court to dissolve our union and grant me custody of our only child so that I can inculcate in her the right values.”
Zainab in her testimony said: “I met my husband in 2014 and he impregnated me while we were courting.
“I moved into his house as his sixth wife and then, my life fell apart.
“I never enjoyed a moment of our marriage because he is cruel and was always beating me.
“We fought throughout my pregnancy, but I was lucky to be delivered of a healthy child.
“My husband impregnated another woman and married her as his seventh wife while our child was only three months old.
“Yinusa constantly shirked his responsibility towards me and our child. He neglected us.
“My husband has no shame. He was always demanding money from me without doing a refund.
“Any day I turned down his request, he would come to my shop and beat me to a pulp.
“I once got fed up with his maltreatment of me and reported him to the police.
“I moved out of his house when I could no longer cope with his rash dealing of me.
“My lord, I agree to divorce, but I beg the court to grant me custody of our child whom he has neglected for long.
“He has refused to pay her school fees and carry out other responsibilities as it is expected of him.”
The court president, Mrs S.M Akintayo, adjourned the case after she had heard both parties.
