Malaysia has introduced updated guidelines for foreign nationals holding Employment Passes (EP) to enhance the process of category adjustments. These changes, implemented by the Immigration Department, aim to streamline procedures, ensure compliance, and increase transparency for both employers and employees.
The Employment Pass is a work permit that enables expatriates to work in Malaysia, typically valid for up to 60 months based on the employment contract. Pass holders can also apply for a Dependant Pass to bring their spouse and children under 18 years old to the country.
One notable update is that employers must now cancel an existing Employment Pass when applying for a category change. Additionally, a “change of category letter” will be required for application approval. This particular change will come into effect on January 1, 2025.
These new requirements are designed to improve the clarity and accuracy of the application process, according to TravelBiz. Employers are encouraged to familiarize themselves with the updated steps to ensure a smoother transition when changing Employment Pass categories.
To apply for an Employment Pass, both employers and foreign workers must meet specific requirements. Employers must be approved to hire expatriates, and the employee’s role must be validated by the Expatriate Committee or other relevant authorities. Furthermore, applicants must provide the required documentation, including the new category change letter.
Employment Pass holders remain tied to the employer listed on their pass. Any intention to switch employers necessitates a fresh application for a new Employment Pass. Malaysia offers various other work permits tailored to specific employment needs, such as:
Professional Visit Pass (PVP): For short-term assignments, valid up to 12 months.
Temporary Employment Pass (TEP): For unskilled or semi-skilled roles, often in manufacturing or agriculture.
Resident Pass-Talent (RP-T): A renewable 10-year visa for highly skilled professionals, allowing flexibility to work with any employer.
In addition to the procedural updates, Malaysia has raised fees for several visa categories. The cost of an Employment Pass has increased from MYR 800 to MYR 2,000, while the Dependant Pass fee now stands at MYR 500, up from MYR 450. Other visa types, such as the Professional Visit Pass and Long-Term Social Visit Pass, have also experienced fee adjustments.
The government anticipates that these fee increments will accelerate processing times for critical sectors. The revised Employment Pass system aligns with Malaysia’s broader efforts to improve immigration efficiency and support sectors vital to the country’s economy. Employers and expatriates must stay informed about these updates to avoid delays or complications in the application process.
