“S.6 has clearly provides for the notification of cause of arrest and rights of the suspect and that the authority having custody of the suspect shall have the responsibility of notifying the next of kin or relative of the suspect of the arrest at no cost to the suspect”, he explained.
Adding that the complication in the judiciary in Nigeria presently is that, over 90 percent of the arrested are not being investigated well thereby making it difficult for judges and lawyers to handle.
however, he pointed out that “S.7 clearly prohibit arrest in lieu. This will likely reduce congestion in Police cells, prisons and other detention facilities”.
He, therefore, stressed, “the provisions will also affect other agencies vested with the power of arrest, like the Economic and Financial Crimes Commission (EFCC), National Drug Law Enforcement Agency (NDLEA) and National Agency on Food Drug Administration and Control(NAFDAC)”.
