The judge made the order while adjourning Sanda’s trial till Thursday, December 7 following her arraignment before the court by the Commissioner of Police,FCT, on a two-count charge bordering on culpable homicide punishable with death.
Count one of the charge alleged that Maryam Sanda did commit the offence of culpable homicide by causing the death of Bilyaminu Haliru Bello by stabbing him on the chest with a broken bottle, which eventually led to his death.
She was alleged in count two to have at about 0350 hour on November 19 committed the offence of causing grievous hurt by stabbing Bilyaminu with a broken bottle on the neck thereby endangering his life.
She pleaded not guilty to the charges when they were read to her in court yesterday.
The prosecution counsel, James Idachaba, had informed the court that the charge, dated and filed on November 20, was brought before the court pursuant to Sections 221 and 247 of the Penal Code.
Following the not guilty plea of the defendant, Idachaba informed the court that the two-count charge was a product of the preliminary investigation of the police.
He added that new facts had emerged which would necessitate the charge to be amended later.
The prosecutor, thereafter, asked for a date for commencement of trial.
While saying he was not opposed to the adjournment sought by the prosecution, counsel for the defendant, Hussein Musa, made an oral application for Sanda to be granted bail.
The trial judge, however, directed that the defence should formalize the bail application.
Musa also urged the court to remand the defendant in police custody in view of the fact that she is nursing a baby who is less than six months old.
Justice Yusuf thereafter adjourned till December 7 for hearing of the matter.
