Omolade had brought a divorce suit against Tope, claiming that he neglected and abandoned her and their children.
She thus sought for divorce and custody of their three children.
The defendant did not admit to claim and also disagreed that his wife should have custody of their children.
After he had listened to both parties, the court president, Chief Olasunkanmi Agbaje, stated that more evidence would be needed. He, therefore, adjourned the case till December 7, and ordered both parties to come to court with their children and parents.
The plaintiff when giving her evidence stated thus:”My 1o-year-old marriage to my husband has been void of intimacy and the necessary attention needed to sustain it. I can’t remember when last we both laughed together nor had a chat. If we are not arguing over an issue, then we are fighting.
“He works in Lagos and returns home at weekends. When he’s back, he goes straight to his mother’s place and spends the whole weekend there.
“He doesn’t ask after the children and he’s not interested in their education and general welfare. I bear the responsibility of feeding, clothing and training of our children in school.
“His mother is fully in support of his misbehavior and welcomes him with open hands every weekend he returns from Lagos.
“I have tolerated his unloving and uncaring attitude towards me and our children for long and can’t take these any longer. I pray that you separate us, “Omolade said.
“My lord, all she has said is a lie. I’m a responsible man and I take good care of her and our children. I gave her a sum of N20, 000 recently as our children’s school fees and another N10, 000 as feeding allowance.
“We had a minor problem before I went back to Lagos. This our landlord mediated into and got it resolved.
“My wife makes our home boil whenever I’m experiencing financial strain. Her principle is, ‘no money, no happiness’, which was my reason for staying back in Lagos during the last Ileya festival. This decision brought about a rift in our relationship.
“She fought me, kept malice with me and later moved her belongings out of my house. She also went with some of my things. She refused to come back to me after her brother mediated in our differences and instructed her to do so. She came back few weeks after and dropped the children with me.
“I later learnt she is sleeping around.
“My lord, I slept with my wife on the 20th of March this year and I noticed that she had taken in. I warned her not to abort the pregnancy, she therefore still owes me an explanation on what has happened to it, “the defendant stated.
