The Delta State Government has unveiled plans to establish the Delta State Electricity Regulatory Commission (DSERC) and the Delta State Rural Electrification Agency (DSREA) before the end of 2026 as part of efforts to deepen electricity sector reforms, expand access to power and attract private investment.

The disclosure was made during a panel session at the Delta State Economic and Investment Summit 2026, where government officials, regulators and private sector stakeholders outlined strategies for building a competitive electricity market in the state.

According to the panelists, the state government is working with the Ministry of Energy and prospective investors to ensure that both institutions become operational before year-end. They added that public consultations would precede the rollout of Delta State’s electricity market framework, while an investor toolkit detailing regulatory requirements and investment opportunities would be released after stakeholder engagements by the new regulatory board.

The stakeholders noted that the Electricity Act has opened the door for states to regulate electricity generation, transmission and distribution within their jurisdictions, providing Delta with the opportunity to develop its own electricity market.

They identified the 1,000-megawatt Transcorp Power generating plant located in the state as a major asset capable of meeting a significant portion of Delta’s electricity demand if supported by adequate investments in electricity distribution infrastructure.

The panel also highlighted opportunities in the state’s gas sector, urging investors to take advantage of the Nigerian Upstream Petroleum Regulatory Commission’s Gas Flare Commercialisation Programme.

They observed that gas flaring has reduced significantly in recent years due to increased gas-to-power projects and other commercial gas utilisation initiatives.

They further noted that Delta continues to attract investments in compressed natural gas (CNG), mini-LNG and gas-to-power projects, positioning the state as a growing energy investment destination.

Despite the prospects, stakeholders identified inadequate gas supply, ageing infrastructure, transmission bottlenecks and electricity theft as major challenges limiting the growth of the power sector.

A representative of Transcorp Power said poor gas supply and constraints within the national transmission network continue to restrict electricity generation and discourage additional private sector investment.

The panel described the Delta State Electricity Law as one of the country’s most progressive electricity legislations, noting that it contains provisions to penalise electricity theft while protecting communities from being compelled to finance public electricity infrastructure.

According to the panelists, the law will be more effectively implemented once the Delta State Electricity Regulatory Commission becomes fully operational.

They agreed that expanding electricity distribution infrastructure remains the state’s most urgent priority, stressing that a stronger distribution network would unlock Delta’s power potential, improve electricity supply to households and businesses, support industrialisation and enhance the state’s attractiveness to local and foreign investors.
