Grade A Customary Court, Oja Oba, Mapo, Ibadan, Oyo State, has ruled that a couple, Victoria Adetayo and Michael Adetayo go their separate ways on the grounds of irreconcilable differences.
Victoria, who brought a divorce suit against her husband, stated that there was no more love between them.
Victoria explained that her marriage brought her sorrow rather than joy because her husband was inhumane.
According to the plaintiff, the defendant was cruel, violent and often abused her verbally and physically.
The plaintiff told the court she almost lost an eye as a result of his husband’s brutality.
Victoria further stated that Michael kept late nights despite the state of security in the nation.
The plaintiff explained that he always left her and their children in fear until he returned home at ungodly hours.
She told the court that her husband finally sent her packing and brought in another woman into their matrimonial home.
Victoria thus prayed the court to dissolve their wedlock so that she could move on with her life.
She pleaded for the custody of their children, but requested that her husband be made to be in charge of their upkeep with adequate attention given to feeding, formal education and health care.
Michael was absent in court despite being served with hearing notices.
Victoria testimony went thus:
“My husband and I had a traditional wedding and his family brought my family gifts during the occasion.
“They also came along with my bride price, but my parents returned it to them.
“My lord, the joy in our marriage lasted only that day.
“I discovered too late that I was married to a callous human being.
“All that my husband offered me throughout the time we lived together was sorrow and a heavy heart.
“Michael always got me agitated because he was in the habit of keeping late nights despite the sorry state of security in the nation.
“Our children and I always kept the watch until he returned in the deep of the night.
“The more I complained the worse he became.
“I stopped complaining after he took to beating me.
“Michael never saw any good in me.
“He derived pleasure in assaulting me verbally and physically and was fond of using unprintable words at me.
“My husband once beat and almost killed me.
“He eventually damaged one of my eyes with his punches. I almost went blind because my vision was impaired.
“My husband later threw me out of his house and then brought in another woman.
“My lord, I believe it is time to move on with my life.
“I, therefore, pray for the dissolution of our marriage and custody our children.
“I also beg the court to mandate him to be responsible for our children’s welfare and give adequate attention to their feeding, education and health care.
“I further plead that he should be restrained from threatening me.”
The president of the court, Mrs S.M Akintayo, giving her judgment stated that there was no marriage to be dissolved between the two because no bride price was paid.
She also stated that it was wise that both go their separate ways since the evidence given by the plaintiff tilted towards violence.
The defendant was mandated to be responsible for their children’s upkeep.
A copy of the judgment was asked to be served the defendant.
