The appeal by the immediate past governor of Kogi state, Capt Idris Wada of the Peoples Democratic Party (PDP) divided the Justices of the Court of Appeal.
While four Justices of the appellate court who sat on the appeal dismissed Wada’s appeal and upheld the judgment of the Tribunal which affirmed the election of Yahaya Bello of the APC, one of the Justices said Wada’s appeal is meritorious.
He said the Tribunal erred in law to have affirmed the election of Yahaya Bello, who did not participate in the stages of the election.
Judgment in the appeal by the Labour party against the decision of the Tribunal which dismissed it petition challenging Bello’s election has just began.
