Grade A Customary Court, Mapo, Ibadan, Oyo State, has dissolved the union between a couple, Idowu and Alake, on the account of no love, lack of care and irreconcilable differences.

Idowu, who dragged his wife, Alake to court stated that their marriage failed as a result of the latter’s unloving and uncaring attitude towards him.

According to Idowu, Alake was indifferent to his wellbeing and also failed in her role as a helpmate.

The plaintiff added that their home knew no peace because he and the defendant were always at each other’s neck.

He further said that both started living separately and later remarried after their differences could not be resolved.

Idowu explained that he came to court to have their wedlock officially terminated.

The plaintiff also pleaded for custody of the only child in their union, whom he stated the defendant failed to give adequate care.

Idowu, among other things mentioned, specifically their child’s dressing, which he stated was indecent.

According to Idowu, Alake loved to dress their son in ripped jeans, which was displeasing to him.

Alake agreed that their union be dissolved but refused that the plaintiff have custody of their child. 

She admitted that the plaintiff paid their child’s school fees on a regular basis but that he never gave her a dime towards his feeding and medical care.

Alake responding to Idowu’s allegation stated that he was the one who brought their child the said jeans.

Idowu gave his testimony, “My lord, I am in court this morning to end officially the relationship between my wife, Alake, and I.

“Our marriage failed as a result of my wife’s neglect of her duties towards me.

“Alake obviously never loved me.

“She felt unconcerned about my welfare and abandoned me when I was going through tough times.

“She refused to share my fears and pains and left me to languish.

“I tolerated my wife for years until our marriage fell apart.

“We started living separately as a result of the irreconcilable differences in our relationship.

“Both of us are now remarried and settled in our new homes.

“Alake presently has our son, the only child produced by our union in her custody, but I want him to be.

“I have never shirked my responsibility towards him.

“I pay his school fees as at when due and also provide for his upkeep.

“I earnestly plead for his custody because Alake is not raising him to be a responsible fellow in the nearest future.

“She dresses our son in ripped jeans and makes him appear like a tout.”

Alake responded, “Idowu and I started living together after he impregnated me, and I bore him our son.

“It is true he is responsible for our child’s education, but he lied concerning his welfare.

“I have always been responsible for his upkeep and medical care.

“He buys things for our son only when he spends his holiday with him.

“He bought the ripped jeans he made mention of for our son.

“My lord, I appeal to this honourable court to allow our son to remain in my custody while my Idowu is mandated to be responsible for his feeding and medical care   in addition to his education.”

The president of the court, Mrs S.M. Akintayo, giving her judgment dissolved their union and granted the defendant custody of their child, while the plaintiff was ordered to remain responsible for his education while she added that of feeding and medical care to it.
