A Magistrate Court in Bwari Area Council, Federal Capital Territory, Abuja, has adjourned the hearing on the case of alleged “criminal conspiracy and kidnapping” against Mr David Solomon and Mrs Janet Funso Adeniyi, 1st and 2nd defendants respectively, to 7th August 2023.
The Magistrate of Bwari Magistrate Court 6, Justice Taribo Zimizu, also adjourned the ruling on the bail for the 2nd defendant, Mrs Janet Funso Adeniyi, mother of the two children said to be in the custody of the Lagos State government, to August 2nd, 2023, after hearing the motions of the prosecuting and defence counsels.
Janet is the mother of David Solomon and the twins allegedly kidnapped but are currently in the custody of the Lagos State Ministry of Youth and Social Development due to alleged abuse, following the petition of the mother.
The accused and mother of the twins had earlier petitioned the Lagos State Ministry of Youth and Social Development in an effort to save her children from further “sexual and physical abuse” while they were under the care of the father, Mr Emmanuel Ogunagbe.
At the continuation of the hearing, the prosecuting lawyer, Okoro Nnachi, who held brief for Adama Musa, prayed the court not to grant bail to the second accused, as he feared the mother of the children may jump bail.
He further argued that the 2nd defendant must submit her British passport to the court to guarantee that she does not constitute a flight risk to the court.
In his countermotion, the defence attorney, Ken Ogbobo, said the court should cancel the term of the bail condition proposed by the prosecuting counsel in its entirety.
He told the court that the mother of the children does not constitute a flight risk, as her Nigerian international passport, with which she travels in and out of the country, has been deposited with the court.
He pointed out to the court that the British passport of the mother of the kids alleged to have been kidnapped by her and her son (David) was missing, and this was further confirmed by the tendered report of the police investigation.
He asked the court to grant the second defendant bail on grounds of satisfactorily meeting the bail conditions, stressing that the missing British passport does not make her a flight risk.
Ogbobo also urged the court to grant bail to the 1st defendant, David Solomon, whose bail was revoked due to his absence at the July 17 hearing owing to ill health.
He said the defendant did not jump bail but was receiving treatment for a critical health condition for which the court has been provided evidence.
The court has reserved a ruling on the variation of bail conditions for the 2nd defendant on August 2, 2023.
