Mohbad: Naira Marley, Sam Larry sue magistrate, police, demand N40m

Singer Azeez Fashola, popularly known as Naira Marley, and Samson Eletu, better known as Sam Larry, have filed a fundamental rights lawsuit to challenge their “continued detention” in connection with the death of singer Ilerioluwa Aloba, also known as Mohbad.

Both Naira Marley and Sam Larry are demanding N20 million in damages from the police and Lagos magistrate Adeola Olatunbosun, citing what they view as their extended detention while in police custody.

Naira Marley and Sam Larry were named defendants in the lawsuit filed at the Federal High Court in Lagos.

The magistrate had previously ordered the detention of Naira Marley and Sam Larry in police custody for 21 days in relation to the death of 27-year-old Mohbad, who passed away in September.

However, Olalekan Ojo (SAN), the legal counsel for Naira Marley and Sam Larry, informed Channels Television that both defendants are urging the court to declare that their ongoing detention “at the Homicide Section of the Lagos State Police Command, Panti, Yaba, Lagos State since October 4, 2023,” constitutes a violation of their rights.

They argue that the magistrate’s order of remand was only for 21 days, and that period has now expired. They are seeking “an order from the court for the immediate release of the applicants.”
