A legal professional, Mr Kayode Oshiyemi, who was arrested, detained and paraded by the Ogun State police command over a case of conspiracy, attempt to kill, kidnap and obtaining under false pretences, has been exonerated of the allegations.
A legal advice from the office of the Attorney-General of Ogun State, signed by the Assistant Chief State in Counsel, Mrs Abimbola Akisanya, stated that the evidence in the case file was not strong enough to recommend any charge against Oshiyemi and other suspects.
The office of the Commissioner of Police, Ogun State, had earlier, via a letter with reference No AB 3514/OGS/X/R/SARS/U.1/349, dated July 18, 2018 requested for legal advice in respect of the matter.
“I have critically considered the available evidence contained in the police duplicate case file and it is evident that following the receipt of the petition by the police and investigation, the suspects were arrested and it revealed the issue that there was a lingering dispute between the complainant and the suspects which all led to series of litigations in the courts.
“There also exists, from admission by the fourth suspect, Kayode Oshiyemi, in his extrajudicial statement that he had called the complainant with the intention not to kidnap, but only working to protect the clients. He denied any plan of intention to kidnap the complainant,” the legal advice noted.
The state SARS had earlier arrested, detained and paraded Mr Kayode Oshiyemi, Mr Adebowale Ogunlaja, Mr Abolaji Alaba and Mr Sodiq Owolabi over alleged conspiracy, attempt to kill, kidnap and obtaining money under false pretences just as the legal practitioner subsequently challenged the action of the police in court during which the sum of N10 million damages was awarded in his favour.
The Nigerian Tribune edition of July 2, 2018, at page 32, published a story with the headline, ‘Lawyer in police net for allegedly planning to defraud businessman’ from a press release obtained from the office of the Police Public Relations Officer, Ogun State command. The Nigerian Tribune Newspaper regrets any embarrassment the publication might have caused Mr Kayode Oshiyemi.
