…as Court adjourns till 13th May 2025
The absence of defence counsel and the defendants has stalled the case instituted against Cedarhaus realtors and Muyiwa Bamgbose by Idowu Lawanson and other concerned residents of Cedarhaus Estate, Oluyole Estate, Ibadan, at the Oyo High Court sitting in Ibadan on Thursday.
The Claimants in the suit are: Idowu Lawanson, Anike Lawanson Tayo Sowunmi, Bimpe Sowunmi, Mr. Oyedokun, Damola Oyedokun, Chukwunonso Anene and Monica Anene.
They are being represented in the Court by Mr. Olakunle Faokunla Esq., and Mr. Olufemi Oyedipe Esq.
Counsel to the claimants and two of the claimants were in the Court, but neither the counsel to the defendants nor the defendants were represented in the Court when the case was mentioned.
However, after the mentioning of the case, the presiding justice, Muraina, adjourned the case till 13th May 2025 for the hearing of the motion to set the suit down for trial.
The prayers of the claimants in a 22-paragraph summons include, “That the 1st and 2nd Claimants are the beneficial owners of all the parcel together with buildings thereof situated, lying on plots 1 and 2 Block A Cedarhaus Estate, Oluyole’ Estate, off Ringroad in Ibadan, Oyo State, having purchased same from the defendants.
“That the defendants are under the duty to prepare and execute a Deed of Assignment in favour of the 1st and 2nd Claimants in respect of all the parcel of land situated, lying and known as Plots 1 and 2 Block A Cedarhaus Estate Oluyole’ Estate off Ringroad in Ibadan, Oyo State.
“Of Specific Importance is compelling the defendants to prepare a Deed of Assignment in favour of the 1st and 2nd Claimants.
“Also award of N50m general damage for and in favour of the 1st and 2nd Claimants for the failure of the defendants to prepare and execute a Deed of Assignment in favour of the 1st and 2nd Claimants in respect of all that piece or parcel of land situated, lying on Plots 1 and 2 Block A Cedarhaus Estate, Oluyole’ Estate off Ringroad in Ibadan, Oyo State.”
