The Supreme Court has dismissed the application brought before it by the immediate past governor of Imo state, Emeka Ihedioha seeking the setting aside of its January 14, 2020 judgment sacking him from office and ordered the swearing in of Senator Hope Uzodinma of the All Progressive Congress (APC) in his place as the state governor.
In the six to one decision of the apex court, the court held that it cannot sit on appeal over its judgment.
In the judgment delivered by Justice Olukayode Ariwola, the court dismissed Ihedioha’s application, without cost.

But, in a dissenting judgment delivered by Justice Chima Centus Nweze held that the application has merit and ordered the setting aside of the apex court’s judgment that sacked Ihedioha.
He also, in his judgment ordered that certificate of return issued to Uzodinma be retrieved and a fresh one issued to Ihedioha.
