United States President Donald Trump has signed a new executive order imposing penalties on individuals who burn or desecrate the American flag.
In a statement released by the White House on Monday, the president described the flag as one of the most iconic symbols of the nation, representing its identity, freedom, and strength.
“Our great American Flag is the most sacred and cherished symbol of the United States of America, and of American freedom, identity, and strength. Over nearly two-and-a-half centuries, many thousands of American patriots have fought, bled, and died to keep the Stars and Stripes waving proudly,” Trump said.
He further stressed that the flag should serve as a unifying emblem for all citizens, irrespective of their differences.
“American flag is a special symbol in our national life that should unite and represent all Americans of every background and walk of life,” he added.
According to the order, the American flag is recognised as one of the most enduring symbols of the country, with efforts to desecrate it viewed by the administration as acts that could incite hostility or violence.
It cites the Supreme Court’s rulings on First Amendment protections but notes that the Court has never held that flag burning likely to provoke imminent lawless action or deemed as “fighting words” is constitutionally protected.
The directive empowers the Attorney General to enforce criminal and civil laws against flag desecration where it violates content-neutral laws and results in harm, including violent crimes, hate crimes, civil rights violations, and property damage. It also directs federal agencies to refer such cases to state or local authorities where applicable.
In addition, the order authorises the Secretary of State, the Attorney General, and the Secretary of Homeland Security to deny or revoke visas, residency, naturalisation, or other immigration benefits for foreign nationals found guilty of flag desecration, and to seek their removal where permitted by law.
The order, which took effect immediately upon signing, states that if any part is found invalid, the remaining provisions will remain enforceable.
