A 63-year-old man, Yaya Ogun, has been arraigned before a magistrate court sitting in Ede, Osun State, for allegedly trespassing on land and threatening the owner.
The defendant, who was arraigned by the state police command, is accused of committing the crime sometime in 2021 at the Agip area of Ede, where he allegedly threatened one Yinka Omisade, the landowner.
The charge sheet against the defendant reads:
“That you, Alhaji Yaya Ogun ‘M’, and others at large, sometime in the year 2021 at Ede in the Ede Magisterial District, did conspire among yourselves to commit a misdemeanour, to wit: Threat with Violence and Forcible Entry, and thereby committed an offence contrary to and punishable under Section 517 of the Criminal Code Cap 34 Vol. II Laws of Osun State of Nigeria 2002.”
“That you, Alhaji Yaya Ogun ‘M’, and others at large, on the same date, place, month, and year in the aforementioned Magisterial District, did arm yourselves with dangerous weapons such as cutlasses and charms, etc., and did threaten the life of Yinka Omisade ‘M’ and others, thereby committing an offence contrary to and punishable under Section 86 of the Criminal Code Cap 34 Vol. II Laws of Osun State of Nigeria 2002.”
“That you, Alhaji Yaya Ogun ‘M’, and others at large, on the same date, place, month, and year in the aforementioned Magisterial District, did conduct yourselves in a manner likely to cause a breach of the peace by entering the land situated at Agip area, Ede, which is in the actual and peaceable possession of Yinka Omisade ‘M’, thereby committing an offence contrary to and punishable under Section 81 of the Criminal Code Cap 34 Vol. II Laws of Osun State of Nigeria 2002.”
The defendant pleaded not guilty to the three-count charges of conspiracy, forcible entry, and threat to life.
Counsel to the defendant, Lekan Olayiwola, urged the court to grant his client bail on the most liberal terms, assuring the court that he would not jump bail.
The magistrate, Veronica Adedokun, granted the defendant bail in the sum of N1 million and one surety in like sum. She specified that the surety must be a civil servant who must present proof of residence and tax clearance.
Magistrate Adedokun ordered that the defendant be remanded in a correctional centre pending the perfection of the bail conditions. She adjourned the case to September 23 for a hearing.
