A woman, Barakat, has sought for the dissolution of her 11-year-old wedlock to her husband, Alimi, whom she accused of being irresponsible, stubborn, and unforgiving.
She added that he was violent.
Barakat stated that Alimi always gave excuses not to be responsible for their children’s welfare and would beat her black and blue anytime she challenged him to be up to his responsibility in the home.
The plaintiff also stated that the defendant was fond of sticking to his views even when it was obvious that he was wrong, which made him appear foolish.
She further said that he found it difficult to forgive and would always refer to her deeds in the past, which she had apologised for over and over again.
According to the plaintiff, she packed her belongings and moved out of the defendant’s house when she could no longer bear with his maltreatment of her.
Barakat further said that Alimi has refused to be committed to their children’s welfare since she left him.
She added that he vowed to deal with her anytime their paths crossed.
Barakat, therefore prayed the court to grant her custody of their children and make the defendant responsible for their upkeep by giving her N40,000 as feeding allowance per month, and also see to their education and health care.
She again sought an order restricting him from threatening and interfering with her private life.
Alimi gave his consent to divorce but disagreed that his wife had custody of their children.
The defendant explained that the plaintiff denied him access to their children despite being responsible for their education.
According to him, he stopped giving his children a feeding allowance of N3,000 per day because his wife restricted him from seeing them.
The defendant further said that the plaintiff exposed their children to child abuse by making them hawk goods at motor parks, thereby exposing them to an unhealthy lifestyle.
Barakat, in her evidence, said, “My husband and I conducted our marriage under Islamic induction 11 years ago.
“He paid my bride price, but my parents returned it to him.
“My husband is a brute, and he started beating me from the outset of our marriage.
“He took to beating me because I always insisted he played his role as breadwinner in the home.
“My husband always came up with a reason not to perform his role towards me and our children, which was the reason we fought every now and then.
“My husband, being a violent person, hit me with any object within his reach and would leave me hurting.
“He also loved to have his way even when it was glaring that his was foolish and that he was heading for a pitfall.
“My husband found it hard to forgive.
“He would refer to incidents which occurred between us years back with bitterness and swore not to forgive.
“I moved out of his house after I realised there was no end to my suffering.
“He has not given our children a dime for food or school since I left him.
“I entreat this court to grant me custody of our children and order him to play his full role as father and breadwinner towards them.
“My lord, I want my husband to give our children 40, 000 per month for food and also pay their school fees and medical bills.
“He threatens to beat me anytime, our paths crossed.
“I, therefore, request an order restraining him from threatening and interfering with my private life.”
Alimi responded, “I pray the court to award me custody of our children because my wife is abusing them.
“I saw the hawking goods at a motor park which is not idle for children of their age.
“My mother and Sis are presently living with me.
They will help in taking care of them.
“She lied that I never attended to our children’s needs.
“I have not stopped paying their school fees till date.
“I was giving them N3,000 per day for food, but I stopped this because she refused me access to them.”
The court president, Mrs S.M. Akintayo, ruling, pronounced their wedlock dissolved.
She granted the plaintiff custody of their children and ordered the defendant to be responsible for their upkeep, education, and health care.
She further restrained the defendant from threatening and interfering with the plaintiff’s private life.
