Kwara court arraigns monarch over alleged abuse of power

An Upper Area Court, sitting in Ilorin, Kwara state has arraigned a traditional ruler, Alarandun of Arandun, Oba Ibikunle Olapade, who was brought before the court on allegation of intimidation by one Alhaji Ibrahim Gbenga Ibuoye and some others.

The court, on Tuesday, also turned down the request to dismiss the case against the monarch.

Earlier, Oba Olapade’s counsel, Barrister Olasehinde Adeseko, has prayed the court to dismiss the case against his client, premising his reason on the absence of the complainant, Alhaji Ibuoye, in court.

Adeseko, in his submission, said that Ibuoye failed to provide the court reason for his absence, claiming that it was done out of negligence and that court should terminate the case in his client’s favour.

Barrister Olayinka Dauda Jimoh, who represented Alhaji Ibuoye, prayed the court to disregard the prayer of his senior colleague, Adeseko, claiming such development was not known to law.

Jimoh argued that the law cited by Adeseko was not applicable in the case because law permits his client to have legal representation of his choice, who will defend his claims.

He added that terminating the case would amount to injustice against his client who seek redress before the court over the treatment allegedly meted out to him by the monarch.

Jimoh, however, informed the court that he was leaving the bail to the discretion of the judge, while Adeseko prayed that his client should be released on bail on self-recognition.

The court presided over by Judge Ajibade, admitted the monarch on self-recognition while the matter was adjourned to September 18, 2023, for definite hearing.
