The Nigerian Electricity Regulatory Commission (NERC) has officially transferred regulatory oversight of the electricity market in Kogi State to the Kogi State Electricity Regulatory Commission (KSERC).
In a statement issued on Wednesday, NERC explained that this move aligns with the amended Constitution of the Federal Republic of Nigeria (CFRN) and the Electricity Act 2023.
Under the amended EA 2023, NERC remains the central regulator, overseeing inter-state and international electricity generation, transmission, supply, trading, and system operations.
However, states intending to establish and regulate their own intrastate electricity markets are required to notify NERC and formally request the transfer of regulatory authority to the respective state regulators.

Kogi State Government fulfilled these legal requirements, prompting NERC to transfer regulatory control of the state’s intrastate electricity market to KSERC.
As part of this transition, NERC has directed the Abuja Electricity Distribution Company (AEDC) to create a subsidiary, AEDC SubCo, to manage electricity supply and distribution within Kogi State. AEDC is required to complete the incorporation of this subsidiary by November 12, 2024.
“The subsidiary must also secure a license from KSERC for the intrastate supply and distribution of electricity,” NERC noted. All transfers are expected to be completed by March 12, 2025.
