The Sarkin Dawaki Babba, Aminu Babba Dan-Agundi, a senior member of the Kano Emirate Council, has rejected the Court of Appeal’s verdict nullifying the Federal High Court’s ruling on the Kano emirship dispute.
It be recalled that the Appeal Court had overturned Justice Abdullahi Liman’s ruling, stating that the Federal High Court lacked jurisdiction over chieftaincy matters, which fall under the purview of state high courts.
However, Dan’Agundi, who expressed dissatisfaction with the judgment said he has directed his legal team to challenge before the Supreme Court.
However, making this declaration of heading to Supreme Court on Sunday known while addressing a World press conference, at the Nassarwa palace of the 15th Emir Of Kano Aminu Ado Bayero, the Sarkin Dawaki Babba, Aminu Babba DanAgundi, who was reacting to the ruling by the Appeal Court, said, “Sanusi did not even understand that he has completely lost out in the whole of the cases at hand.
“We were not arguing on the powers of State Assembly to enact repeal laws, what we were asking was lack of fair hearing on the 15th Emir Aminu Ado Bayero that he was removed without giving him a chance to protect himself.
“The State Assembly does not follow right procedures in the enactments of repealing of the Laws, because they did not follow due process of among other Public hearing and so many other things.
“That is why I expressed regrets over remarks by the 16th Emir of Kano Muhammadu Sanusi ii, using Mosque pillar to propagate something that was not true and did not happen at the Appeal Court.
“We initially went to Federal High Court seeking the nullification of repealed Law by the State Assembly, which we felt was done half-hazardly”.
He, however, warned Muhammadu Sanusi II to stop parading himself as the Emir of Kano, because they have sought for stay of prosecution of the Appeal Court judgment at the Supreme Court.
He insisted that Aminu Ado Bayero remains the rightful Emir of Kano and urged Sanusi and the Kano State Government to refrain from celebrating the Appeal Court’s verdict until the Supreme Court’s decision.
“That the position of Muhammadu Sanusi II that he emerged victorious was wrong, the Court said that the Federal High Court has no legal right to hear issues with regards to Chieftaincy affairs. But what we went to Court was different”.
He asked the Police and the DSS to stop the 16th Emir of Kano Muhammadu Sanusi II from allegedly moving around with hugs because he was trying only to disrupt the peace of Kano.
He (DanAgundi)reminded me that he spent 17 years seeking the protection of his rights when he was removed by the late Ado Bayero. Adding that Sanusi will not claim victory until the Supreme Court judgment is been given.
He said; “The StateAttorney General, Speaker Kano State went to Court seeking Bayero to stop parading himself as Emir, but the appeal Court rejected that position and said that Bayero was not given fair hearing, by this it clearly shows that Bayero is still the Emir of Kano. ”
While commenting renovation of the Nassarwa Aminu Ado Bayero, he said they still have judgment of a Federal High Court allowing Bayero to stay perpetually at the place and do as he so wishes.
DanAgundi also stated that one of their prayers was that Aminu Ado Bayero should stop being given protection that has been nullified and Court directed that he should be given maximum protection.
