Iyabo in her divorce suit alleged that her husband, apart from being a womaniser never ceased to beat and embarrass her. She thus prayed the court to rule that they go their different ways and hand over their three children to him for care.
“My lord, I am tired of the cat and mouse relationship between my husband and I, Iyabo told the court.
“He feels fulfilled only when he beats me. He beats me over trivial issues and will always leave wounds on me. I’ve become a regular face in the hospital and have spent a fortune treating wounds inflicted on me when beating me.
“My lord, he loves to beat me in the public and when he does, he will not only inflict wounds on me but also strip me naked. The worst of it all is that he will come to my shop with the intention to harass and embarrass me. He calls me unprintable names in the presence of co-traders and tell them lies about me.
“I left for my parents’ house when I realised he would soon snuff life out of me, but he came there to beat me blue-black in the presence of my parents.
“Our differences were resolved, and I moved back to his place but he failed to change. Whenever we have a misunderstanding, he will call our children bastards which I find offensive.
“He rarely cares for them and doesn’t seem bothered whether they have formal education or not.
“My lord, I’m through with him. Please separate us and let him have the custody of our three children so that he can fully carry out his responsibilities towards them as it is expected of him, “she told the court.
“My lord, I admit to divorce but disagree on the custody of our children, “the defendant said.
“I’m on most occasions out of town due to the nature of my job and as such it’s impossible to monitor and offer the kids necessary attention.
“My wife is a habitual liar and has been unfaithful to me. I have details of her immoral acts although she keeps denying these.
“She doesn’t have time for the kids. She abandons them and attends parties even sometimes out of town without my consent. If she’s not at a party, then she’s hanging out with her lovers, ”he added.
“My lord, she’s also a cheat. She collected N36, 000 from me as our children’s school fees instead of N21, 000. I got to know the actual amount through one of our children’s teacher. She changed our children’s school without informing me and later stopped them from schooling. I came back home from my business trip earlier than it was expected and met them at home while their mates were in school, “Yinka further added.
“It is true I beat her. I did so to correct her because she’s too stubborn. I warned her never to go through my phone but she remained adamant, “he stated.
Having listened to both parties, the court president, Chief Ademola Odunade, observed that their relationship had broken down irrevocably.
Ruling, he dissolved their union and offered custody of their children to the plaintiff.
The defendant was instructed to be responsible for the children’s welfare, feeding, schooling and health service most importantly.
In line with this, he was asked to pay the sum of N15, 000 monthly as their children’s feeding allowance.
