He accused me of infidelity; beat me blue-black for denying him sex —Wife

Oja Oba/Mapo Court C Customary Court, Mapo, Ibadan, Oyo State, has dissolved the wedlock between a couple, Rufiat  Kamorudeen and her husband, Ojebode Kamorudeen over allegation of irresponsibility and battery by the latter.

The plaintiff, who stated that she was tired of her husband’s uncaring attitude and constant beatings, prayed the court to terminate their relationship and restrain him from coming to harass or embarrass her at home or her work place.

She further appealed to the court to grant her custody of their two children.

Ojebode did not agree to claim.

Ruling after he had listened to both parties, the court president, Chief Ademola Odunade dissolved their marriage and granted custody of their two children to the plaintiff.

The defendant was mandated to be responsible for the welfare of their two children and pay the sum of N8, 000 monthly through the court for their upkeep.

He was also ordered to be in charge of their education and health care among others.

“My husband doesn’t trust me and is always suspecting that I’m having an affair, “Rufiat told the court.

“I once attended a party while nursing our first child who was then six months old and returned home in the night. He demanded for sex that night and I explained to him that I was tired. He got angry and accused me of sleeping with other men at the party and descended on me with blows.

“I screamed and cried till a chief imam living close to us came to my rescue. He advised my husband to leave home that night and find somewhere else to sleep so as not to cause more havoc. He took to his advice but left with our baby.

“He was away for twenty-four hours and my breasts became swollen because I couldn’t feed the baby. I made a report at the police station and he was later arrested and our baby returned to me, “she added.

“He never cared for our child and never met her needs. I moved out of his house when I couldn’t stick his irresponsible acts any more.

“I returned to him when he had a fatal accident because I still loved him. I nursed him back to health and I later conceived and bore our second child.

“But he got worse. He was not bothered about my survival and that of our children. He moved to his mother’s family house without discussing with me because he could no longer afford the rent of the apartment we were living in. I later moved in with him there.

“My lord, he never stopped accusing me of flirting with other men. His younger brother once beat me during a misunderstanding and he took sides with him.

“The last time he beat me, he sent me packing and I slept in a container for three weeks.

“I’m fed up with him and thus pray the court to declare our marriage dissolved today so that I can live in peace.

“I further pray the court to grant me custody of our two children in order to give them adequate care, “she concluded.

Oyebode did not agree to divorce.

He told the court that:”My lord, she wants to leave me now that I’m financially bankrupt. She ensured I expended all my fortune on her till I’m left with not even a dime in my account.

“She’s presently dating a rich man which explains her reason for seeking divorce. She has consistently been unfaithful to me. She has strings of lovers who call her at unholy hours. One of them unknown to me bought her asbestos to roof her shop and I went to collect these from him on her behalf.

“She destroyed my SIM card and destroyed my chance of getting a contract which I was informed of through a text message sent to my phone. She also frustrated my efforts at getting details of the sum of N50, 000 sent to me through internet transfer.

“It’s true I took our child from her for almost a day and sent her out my house when she was misbehaving. I did these because she was almost frustrating me.

“She once stripped herself naked in the middle of the night and cursed me.

“My lord, despite all she has done, I have decided I won’t divorce her,” he stated.
