The two others in the case include two-time gubernatorial candidate of the Peoples Democratic Party (PDP), Alhaji Umar Mohammed Nasko, and the state’s chairman of the party, Barr. Tanko Beji.
The three suspects have been standing trial over percieved diversion of ecological funds belonging to the state amounting over N2billion since April 2017.
When the case came up for further mention before Hon. Justice Mikhailu Abdullahi on Tuesday, the prosecution counsel, Barr. Boniface Bassey, announced that it was withdrawing from the case.

Counsel to Nasko, Mr Mamman Mike (SAN), in response to the verbal application asked the court to terminate the case since there is no prosecution.
However, Justice Abdullahi in his response said the court would not act on a verbal application and therefore directed the prosecution to put its application in writing.
The judge said if the prosecution puts the application in writing and submits it before the court on Wednesday, he will rule on it.
