A former member of Ekiti State House of Assembly, Dr Samuel Omotoso, has cautioned the State Attorney General and Commissioner for Justice, Mr Wale Fapohunda against using the case of alleged sexual harassment of a 14-year-old girl against him as a tool for political persecution of perceived opponents.
Fapohunda had yesterday said that the police commissioner, Mr Tunde Mobayo had been ordered to commence probe of the Peoples Democratic Party (PDP) chieftain and others associated with the alleged molestation of the girl.
He dismissed insinuations that the medical doctor was being persecuted for his political belief.
“The Ministry of Justice has obtained a protection order on behalf of the 14-year-old. She will be in the custody of the state until such a time when the matter is brought to court.The doctor is innocent until and if he has his day in court. Therefore, it must be stated clearly that the allegation made against him by the 14-year-old girl is simply that. It is an allegation that is currently subject to police investigation, ” Fapohunda said.
But Omotosho in a statement made available to journalists in Ado-Ekiti, the state capital on Thursday asked the Attorney-General to stop being the prosecutor and the judge, explaining that since the case is before competent courts in the land and he has been duly served, he should stay action and allow the law to take its course.
While revealing that he is not afraid of being investigated, he said, “In this case, the Attorney General is acting as the complainant, investigator, prosecutor and the judge and as such, I have taken the matter to the Federal High Court, Ado Ekiti since Tuesday, June 15, 2021. The suit Number FHC/AD/CS/25/2021, in which the Police Service Commission, Inspector General of Police, Ekiti State Commissioner of Police, Mr Wale Fapohunda, Principal of Christ Girls School, Mrs Esan Oluremi Agbaje and others are defendants is already known to all the defendants, having been duly served.Â
“Also, counsel to the mother of the girl in question also informed me that he had also file a suit number HAD/50/2021 at the State High Court, Ado Ekiti, against the Ekiti State Government, the Attorney General and the Principal of Christ Girls Secondary School and others for the abduction of her daughter without her consent and subsequent keeping her out of her reach for two months.
“They abducted the girl since April 26, 2021 and kept her away from her mother ever since without her consent, and the court resumed on June 15, 2021. So on whose order did he keep the girl away from her mother since April 26?”
Omotoso expressed regret that the commissioner is allegedly doing everything possible to nail him over the case, calling on the stakeholders especially the Nigerian Bar Association (NBA) to prevail on him in order to save the nation’s democracy.
