A High Court sitting in Warri, Delta State has dismissed a libel suit instituted against the African Newspapers of Nigeria Plc (ANN Plc), publishers of the Nigerian Tribune.
Justice Onajite Kuejubola of High Court 1, who delivered the judgement on Friday in Warri,
dismissed the suit on the grounds that the Claimant, Mr Andrew Anibor failed to prove the suit against the ANN Plc.
Anibor had instituted a Suit Number: W/203/2018 against the ANN’s Plc Managing Director/Editor-In-Chief, Edward Dickson, and a reporter, Tunde Oyekola as defendants over an alleged publication on August 20, 2012.
The alleged publication bordered on a judgement delivered by Justice M. Umukoro of Delta High Court, Warri Judicial Division on a case with suit number: W/257/2011.
Anibor had earlier filed a suit against the Economic and Financial Crimes Commission(EFCC) over an alleged breach of his fundamental human rights which was consequently dismissed by Justice Umukoro on June 12, 2012.
However, angered by the publication of the court judgement delivered by Justice Umukoro, Anibor instituted a suit against the defendants, ANN Plc praying the court to award him N50 million over alleged defamation.
Speaking with newsmen shortly after the judgement, Mr Femi Edema, the defence counsel said that the Judgement was in favour of his client, ANN Plc.
“The judgement is in our favour, African Newspapers of Nigeria Plc, publishers of the Nigerian Tribune.
“The judgement was read in the open court and the claimant who is also a lawyer was in court.
“He sued ANN Plc for libel and N50 million. The case had been keenly contested, written addresses adopted and today is for judgement.
“As it is now, the judgement is in favour of ANN Plc against the claimant Mr Anibor and that is the end of the case,” Edema said.
