The Oyo State Judicial Panel of inquiry set up to look into cases of police brutality by the disbanded Special Anti-Robbery Squad (SARS) and other units of the police at its sitting, struck out two petitions for lack of diligent prosecution from the petitioners.
The two cases; OYJPPB/014, Mr Suleman Kehinde VS The Area Commander, Nigeria Police Ogbomoso and OYJPPB/015, Kamalden Hasan VS The Area Commander, Nigeria Police Ogbomoso, were struck out by the 11- member panel headed by the retired Chief Judge of Oyo State, Justice Bolajoko Adeniji, on the request of the police counsel, M.A. Ojei.
When the cases were called, Ojei has applied that the panel strike them out as there had never been any representation from the petitioners since the panel started sitting. In its ruling, the panel noted that the case had come up before it five times without the petitioner showing up to prosecute its case or send a legal representative.
“This is the fifth time this case is coming up before the panel and in those five times, the petitioner has never appeared before the panel nor send a legal representative or any other representative. The case is hereby struck out for lack of diligent prosecution from the petitioner,” the panel held.
Also, the panel issued a summons on a respondent identified as woman Inspector Dorcas from the Apata Area Command of the police area command for failing to appear before the panel to defend the case against her.
A man, Anisere Abolade had through his counsel, W.A. Lamid against Inspector Dorcas in a case delineated OYJPPB/067. But when the case was called, in spite of expectations from the police counsel, the inspector failed to appear before the panel.
The panel consequently ordered summons to be issued on her and adjourned the matter till June 1, 2021, for hearing
