Oja Oba/Mapo Court C Customary Court, Mapo, Ibadan, Oyo State recently dissolved the eight-year-old wedlock between a couple, Wasiu Babalola and Basirat Babalola.
Wasiu, who dragged his wife to court, claimed that she was troublesome and refused that he had rest of mind.
Wasiu told the court that his wife was ill-tempered and always became uncontrollable when angry. The plaintiff stated that the defendant was always at loggerheads with her and his first wife and would fight them.
Wasiu explained that anytime Basirat fought with him, she would tear his clothes to shreds and pull his penis.
According to Wasiu, Basirat beat his first wife blue-black and stripped her naked. He added that she also stripped naked while fighting with his younger brother.
The plaintiff further told the court that the defendant went away with all his property after they fought but refused to return them after they were reconciled.
Wasiu stated that his wife frustrated him so much that he attempted suicide by drinking Gamalin 20.
The plaintiff prayed the court to end their relationship so that he could pick up the pieces of his life.
Basirat admitted to claim.
The defendant told the court she loved her husband but that he never valued the affection she showered on him because he was adulterous.
Basirat stated that she caught him in a compromising position with a woman who was close to her and that he later married her.
She added that her husband was a brute. According to her, he was fond of beating her. She stated that he once beat her till she bled while pregnant.
Basirat told the court that she stood by Wasiu when he ran into debt in his business. According to her, he attempted suicide because of the debt.
“My lord, Basirat must leave my house today. The sight of her infuriates me,” Wasiu said.
“Basirat is troublesome and a bad example to our children. She turned my house into a boxing ring because her hobby is fighting.
“My lord, Basirat’s day is made when she fights. Unfortunately, my first wife and I are her targets. She fights us non-stop.
“Basirat looks for flimsy excuses to fight. The last time she fought with my first wife, she beat her to a pulp and stripped her naked. It took much effort by our neighbours to rescue my first wife from her. But for them, she would have been dead by now as a result of the injury she sustained during the fight.
“My lord, Basirat humiliates me day after day. She challenges my authority in the home. The only regret I have in life is that I married her.
“I go about these days almost naked because she has torn almost all my clothes during fights.
“My lord, Basirat didn’t stop at this. Being a wicked human being, she is always targeting my penis when fighting me. She will grab my penis and pull it. I scream and writhe in pain any time she does this. The expression on her face at moments like this is that of satisfaction. It pleases her seeing me in pain.
“The last time she did so, the pain was so excruciating that I slapped her.
“Basirat extended her shameful behaviour to my brother whom she insulted. Their differences ended in a brawl. My lord, before we knew it, she had stripped naked in the glare of every member of the family and neighbours. I wish I could disappear into the thin air as a result of the embarrassment.
“Basirat has turned me into a laughing stock both in our compound and neighbourhood because there is none who has not seen her nakedness.
“I once felt so frustrated that I attempted suicide by drinking Gamalin 20, but people came to my rescue before it caused damage to my entrails.
“There is nothing interesting or exciting about my marriage to Basirat. I feel frustrated and want to get out of it. I, therefore, appeal to the court to separate,” Wasiu stated.
Basirat, giving her evidence, stated that: “My lord, I love my husband dearly and display much affection towards him. But unfortunately, he fails to cherish all the attention and love I shower on him because he was dating a woman close to me and who he eventually got married to.
“He initially denied having anything to do with her despite finding them in compromising state.
“Wasiu was always beating me. He didn’t desist from this even when I was pregnant. He beat me while in this state and I bled profusely.
“My husband is a liar. I wasn’t the cause of his wanting to commit suicide. He incurred debt on his business but I stood by him. I worked hard that we might pay the debt back.
“My lord, he attempted suicide by taking Gamalin 20 because he feared the worst could happen to him if he failed those he was indebted to,” the defendant stated.
Giving judgment, the court president, Chief Ademola Odunade, dissolved their wedlock and granted custody of their children to the defendant.
The plaintiff was ordered to be responsible for their children’s feeding, education, health care among other things.
