Oja Oba/Mapo Court C Customary Court, Mapo, Ibadan, Oyo State, recently heard the prayer of a woman, Shade Abimbola, for the dissolution of her marriage to her husband, Idowu Abimbola.
Shade who brought a divorce suit against her husband claimed that he was troublesome and refused that she had rest of mind.
According to the plaintiff, she can hardly share her thoughts with her husband because he turns every issue into a fight.
She stated that Idowu failed to care of her and their children and that any time she complained, he would beat her with a belt and that he would not stop hitting her until she bled.
Shade further explained that Idowu lacked respect for her parents adding that he once beat her father.
The plaintiff said the height of it was when her husband threw stones at her parents.
Shade told the court she was not willing to go any further in her marriage to her husband and thus prayed that it ruled that they both go their different ways.
The plaintiff also pleaded with the court to grant her custody of their children because of their father’s attitude towards them.
According to her, his brutish manner has taken its toll on them emotionally and psychologically.
Idowu readily agreed to the dissolution of their marriage.
The defendant, who denied neglecting his wife and children accused his wife of infidelity.
According to Idowu, Shade at the outset of their marriage was obedient and submissive, but that she suddenly changed.
Idowu explained that his wife became insolent and uncontrollable, adding that he started dating other men.
The defendant further stated that their children told him that their mother was always bringing into their apartment a particular man every night whenever he was on night duty.
According to Idowu, the children added that their mother and this man always slept together throughout the night.
To buttress his point, the defendant told the court that Shade’s lover once came to their house in the night and on discovering that he was at home, called her out through the window.
Idowu in addition said Shade was always cooking for her lover in their house.
He stated that Shade insulted him the most when she insisted he must apologise to her lover before she agreed to return home during a misunderstanding.
The defendant prayed the court after ending their relationship to grant him custody of their children so that her ways would not rub off on them.
Shade stated that, “My husband is bent on killing me. He descends on me with punches any time we fight and also hit me with a belt.
“Idowu will hit me continuously with the belt and will not stop until the buckle cuts deep into my skin and leaves me bleeding.
“My husband treats me like his slave and waves aside any advice I give him. This makes it difficult to discuss issues with him.
“Idowu does not take care of me and our children. He neglects our welfare and constantly starves us of food.
“The more I complain, the worse he becomes.
“He has no respect for my parents. I reported his brutish ways to my parents but he treated them with contempt when they tried to call him to order.
“My lord, my husband didn’t stop at this. He once beat my father and I when my father attempted to mediate in our differences.
“Idowu added salt into injury when he threw stones at my parents saying they blocked him from access to our children who they put in their custody because he refused to take care of them.
“I moved out of his house after this and moved into a rented apartment.
“He came to beg me the third week after I moved there with the promise to change.
“I agreed to move back home after much consideration, believing that he would change, but unfortunately, he became worse.
“I came to court to save myself from premature death. Idowu wants to cut short my life in my prime, but I am not ready to die now.
“My lord, I plead with this court to end our marriage and grant me custody of our children because he has neglected their welfare enough.
“I further pray this honourable court to mandate him to be responsible for their welfare, feeding and education in particular, ”the plaintiff pleaded.
Idowu in his evidence said: “My lord, I agree that our marriage be dissolved.
“My wife is adulterous and such a woman can kill.
“Shade has changed from the woman I used to know. My wife was submissive and obedient in the early years of our marriage, but she suddenly changed.
“Shade became rude and rebellious; she refused to take to my instructions or heed my warnings.
“She went from bad to worse when she started having affairs with other men.
“Our children told me that she was in the habit of bringing into our apartment a particular man at night when I am on night duty.
“They stated that their mother and this man always slept together throughout the night.
“Shade denied it when I confronted her with the information.
“Unfortunately for her, this man came at a night I was off duty and at home. He went to the back of our apartment, leaned on the wall and called her out from the window.
“My lord, this man was smoking Indian hemp and filled the air with the smell.
“Shade lied he came to charge his phone when I demanded to know who he was.
“My lord, my wife rather than end her illicit affair with her lover got more intimate with him.
“Shade started cooking for her lover in my house. She will prepare him mouth-watering dishes while she prepares me and our children nothing else but poison.
“My lord, I am a responsible man and always treat our children’s welfare as a priority.
“My wife moved out of our home when we fought and I went to beg her because I didn’t want our children to suffer.
“To my chagrin, she insisted I had to prostate and apologise to her lover before she agreed to return.
“My lord, she returned only after I did so.
“Shade is obviously an evil wind that blows no one any good. I no longer want her in my life.
“I entreat the court to rule that our children be in my care so that her ways won’t rub off on them, “he stated.
The court president, Chief Ademola Odunade, after he had heard both parties observed that their union had broken down irretrievably.
Ruling, he dissolved their union and granted custody of their kids to the defendant.
Both were advised to maintain peace.
