Ganiyat had dragged her husband to court accusing him of being erratic, stubborn and nonchalant about her welfare and that of their children.
She stated that she was fed up with their marriage and thus prayed the court to terminate their union and grant her custody of their three children.
She further pleaded with the court if her prayer was answered to restrain him from harassing and fighting her in her place of abode or work place.
Mudasiru agreed to divorce but refused that his wife had custody of their children, his reason being that she had no time for them.
The court president, Chief Olasunkanmi Agbaje, after listening to the testimonies of both parties, adjourned the case till October 24 and ordered them to appear in court on the next adjourned date with their children and parents.
On the adjourned date, all showed up in court. The plaintiff still insisted on divorce while the defendant likewise agreed to claim.
Parents of both parties explained before the court all the efforts they made in settling the couple’s differences but which proved abortive.
Agbaje, after listening again to the couple, observed that there was no more love between them.
He stated that it was needful that their union be dissolved in order to guard against further acts of violence.
He added that the welfare of the children had to be put into consideration. According to him no one can raise children alone.
Ruling, he dissolved their union and granted custody of the eldest child’s, a female, to the plaintiff and the other two who are males to the defendant.
He ordered the defendant to pay N5, 000 monthly as the eldest child feeding allowance and be responsible for the education and health care of the three children.
Ganiyat, while giving her testimony, stated thus:
“I’ve not known peace since I got married to my husband 17 years ago. He’s erratic in nature and difficult to predict.
“He’s fond of complaining and arguing over trivial issues. He loves to have his way always and any time I air my view or stand my ground on an issue, he beats me.

“He’s an irresponsible husband and father as such, my welfare and that of our children is not his concern. He doesn’t know what efforts I put in ensuring there is food on the table while he’s not appreciative of the fact that I go hungry in order that our children receive formal education.
“I left his house and took our children along when he was about snuffing life out of me as a result of his constant beatings.
“My parents took steps in mediating in our crisis. They invited him to their house, but he walked out on them stating that he didn’t know they invited him for such a trivial issue. My parents felt insulted and reported him to his family members.
‘He refused to apologise to my parents despite much pressure from his parents to do so.
“He later came for our children and instructed their teachers not to allow me to see them, having forgotten that I was the one who enrolled them in the school.
“I was later informed by our neighbours and friends that our children were looking unfed and going about in rags.
“I was downcast. I gathered all I had on me, went to the market and bought them foodstuff and also made them new clothes.
“I took these to the children, but my husband burnt all the clothes.
“My parents went to see his parents in regards to our children’s welfare and he insulted them again.
“My lord, it’s better to live alone peacefully and be happy than live with a husband who behaves like someone out of his mind always.”
