Oja Oba/Mapo Court C Customary Court, Mapo, Ibadan, Oyo State, recently dissolved the 14-year-old wedlock between a couple, Olabisi Sulaimon and Ganiyu Sulaimon.
Olabisi, who dragged her husband to court, alleged that he failed to give her and their children attention.
The plaintiff explained that her marriage to her husband had failed to work because they did not understand each other.
Olabisi added that her husband neglected their children’s education. According to her, she’s the one paying their children’s school fees.
The plaintiff stated that she was fed up with their relationship and thus appealed to the court to dissolve their union.
She prayed that the custody of their children be given her so that she could give them the necessary attention.
Ganiyu denied all the allegations brought against him by his wife but agreed that the court end their union.
He told the court his wife had not been faithful to him, adding that the pregnancy she was carrying was not his.
He pleaded for the custody of their children stating that he didn’t want his children to be raised by another man nor their female child exposed to sexual abuse which is now rampart in the society.
“I still can’t explain why I agreed to marry my husband. We obviously do not understand each other. We differ in many ways and hold contrary views on issues. We are always quarreling and this sometimes results in a brawl,” Olabisi stated while giving her evidence.
“I kept the crisis in our home away from my family members because I didn’t want a third party in our marriage. Unfortunately, things went from bad to worse.
“My husband gave me no care or attention while I was pregnant with our first child and this affected my health.
“I ended up having puerperal psychosis after the birth of our first child and it took a while before I was healed.
“The doctor advised that we should try as much as possible to avoid those things that spur arguments in our marriage but my husband failed to heed this counsel. He refused to change.
“I was afraid of being alone with him in Ife where we reside while carrying our second pregnancy because I feared I could fall sick again after child birth as a result of his troublesome nature. I, therefore, decided to stay in Ibadan where my family members reside.
“I had the baby safely and felt good after delivery.
“I informed my husband about the baby and decided we had the naming ceremony in Ibadan.
“He refused to pick my calls after this.
“Our baby later took ill but he refused to come and see him. I carried him along as our child was made to undergo different tests, but he was indifferent to his plight.
“Our child at the end of the day was advised to have a surgery, but to my chagrin, my husband switched off his phone throughout the day the surgery was carried out.
“Ganiyu has never shown interest in our children’s education. He left the payment of our children’s school fees to me.
“I pay N350,000 per session for our three children, while I’m also responsible for their feeding. The last time my husband gave anything towards our children’s education was in 2017 and he gave me only N65,000.
“My lord, I do not want to stay married to my husband again. My experience being married to him is a horrible one.
“I entreat the court to grant me custody of our children because he lacks the ability to raise them well.
“The last time they spent their holidays with him they were speaking foul languages. Apart from this, I spent through the nose giving them medical attention because he fed them with junks,” the plaintiff said.
“My lord, all that my wife said about me are lies. I love our children and take good care of them. Nevertheless, I agree that our wedlock be dissolved because my wife is a slut,” the defendant stated.
“Olabisi is promiscuous and this is the reason she refused to stay with me in Ife.
“My lord, the pregnancy she is carrying is not mine. Olabisi was impregnated by another man while still married to me.
“I gave my wife N20,000 as part of our children’s fee but she threw it away.
“Olabisi can’t deny the fact that I gave her a bag of rice and chicken every month, but rather than cook these for our children, she would dash them out to her relatives and friends.
“I did nothing to contribute towards Olabisi ill health. She was in the habit of complaining and nagging and never satisfied with all I did. She was always working herself up which was the reason she had puerperal psychosis.
“Olabisi had stopped having sex with me since she moved back to Ibadan. She prefers to sleep with other men.
“I requested that she come down to Ife with our children so that we could expose them to Islamic practice but she refused.
“She dragged me to the Welfare office and after they heard both of us, our male child was handed over to me for care, but she put much pressure on me to release the child to her and I later succumbed to her wish.
“I bought her a car so that it could be easy for her to travel from Ibadan to Ife. Olabisi collected this but still refused to come to Ife,” Ganiyu explained.
“I ensured I bought everything our children needed. I bought their uniforms, books, sandals and other necessary things, but she instructed their teachers to deny me access to them. These teachers later demanded for their lesson fee from me which I declined.
“Olabisi stays in a room with our children and this is where the man who impregnated her comes to sleep with her.
“My lord, this kind of setting is not ideal for our children and not safe especially for our female child due to the current high rate of rape in the society.
“I initially planned to drag her to court but she begged me and swore with the pregnancy she was carrying. I didn’t know she was trying to play smart.
“My lord, I pray for the custody of our children since she’s into a relationship with another man. I don’t want my children to be raised by another.
“I also want her to return my mattress, fan and deep freezer,” he concluded.
Ruling after he had heard both parties, the court president, Chief Ademola Odunade, dissolved their union and handed over the first and third children to the plaintiff.
The defendant was asked to give the plaintiff N10,000 every month for their upkeep.
The defendant was given custody of their second child and was mandated to be responsible for the education and health care of all the children.
