Court sentences driver to five years imprisonment for stealing diesel

A Magistrate Court sitting in Akure, Ondo State capital, has sentenced a 43- year old, Musa Nureni, to five years imprisonment for stealing 60 litres of diesel valued at N42,000.

Nureni who was arraigned with Njimi Peter who bought the stolen product, committed the offence on April 15, 2022, at Oremeji Sawmill, along Ondo/Ore road, Ondo in Ondo West Local Government Area of Ondo State.

The two accused were arraigned on two count charges bothering on stealing and receiving stolen goods.

The Prosecutor, Benard Olagbayi, informed the court that Nureni was caught by the complainant, Akin Kayode while attempting to sell the diesel.

The offence contravenes Sections 516, 427 and 390(9) of the Criminal Code Cap 37 Vol.1, Laws of Ondo State, 2006.

The charge read in part,” That you Musa Nureni and Njima Peter on the same date, time and place in the aforementioned Magisterial District did steal 60 litres of diesel valued atvN42,000, property of one Akin Kayode and thereby committed an offence contrary to and punishable under Section 390(9) of the Criminal Code Cap 37 Vol. 1 Laws of Ondo State of Nigeria 2006.

“That you, Njima Peter on the same date, time and place in the aforementioned Magisterial District did receive 60 litres of diesel valued N42,000 knowing fully to have been stolen or obtained and thereby committed an offence contrary to and punishable under section 427 of the criminal code cap. 37 vol. 1 law of Ondo State of Nigeria 2006.

Nureni however, pleaded guilty to the charges levelled against him while Njimi pleaded not guilty.

Counsel to the defendants, Mr O.A Akinbinu, urged the court to show mercy to Nureni as he did not waste the time of the court by pleading guilty and applied for bail for Njimi in the most liberal terms.

The Presiding Magistrate, Mrs Charity Adeyanju, sentenced Nureni to five years imprisonment on the two counts with an option of an N150,000 fine.

Adeyanju granted Njimi bail to the sum of N300,000 with one surety in like sum and adjourned the case to May 16, 2022, for the trial of Njimi.
