TUC demands immediate reversal of controversial tenure policy for trade union officers

THE Trade Union Congress of Nigeria (TUC) has called for the reversal of a newly introduced tenure policy for trade union officers embedded in the Public Service Rules (PSR) 2021 edition and reinforced by a recent circular from the Head of Service of the Federation.

The policy, outlined in PSR Rule 020612 and detailed in Circular No. HCSF/PS/SPSO/268/13/2/38 dated August 1, 2023, imposes a restrictive tenure limit of two terms of two years each for trade union officers, capping the total possible tenure at four years.

Kicking against the policy, TUC argues that the policy undermines the autonomy of trade unions by contradicting established provisions in the Labour Act and many union constitutions, which traditionally permit a four-year term per tenure.

“This new rule not only disrupts internal governance but also infringes on the unions’ constitutionally guaranteed rights to self-management and democratic processes,” the congress said.

In a release by Comrade Festus Osifo, President of TUC, the labour centre described the policy as an overreach by the government and an infringement on the fundamental rights of trade unions.

He emphasised that the autonomy of trade unions is crucial for the protection of workers’ rights and maintaining a fair workplace environment.

The congress demanded an immediate review and repeal of the PSR Rule 020612 and the accompanying circular, calling all union affiliates to unite in opposition to the policy.

“The autonomy and independence of trade unions are vital for the democratic engagement of workers and the effective representation of their interests,

“We call on the Head of Service of the Federation to address this overreach and restore our right to govern ourselves according to our constitutions,” said Osifo.

The TUC’s stance reflects a broader concern about governmental interference in organisational governance, highlighting the need for trade unions to operate free from external constraints.

The congress has mobilised its affiliates to resist the policy and safeguard their constitutional rights.
