Tribunal sacks PDP Rep member in Ebonyi, declares APC candidate winner

National Assembly election petition tribunal sitting in Abakaliki, Ebonyi State, in a judgement delivered by the three-man panel chaired by Justice Sika Henry Aprioku on Monday, declared Comrade Chinedu Ogah of the All Progressive Congress (APC) winner of the 2019 general election.

According to the judge, the APC candidate polled 36,238 votes against the PDP candidate who polled 33,263 votes in the February 23rd 2019 general election.

Justice Aprioku, however, ordered the Independent National Electoral Commission (INEC) to immediately issue a certificate of return to Comrade Chinedu Ogah candidate for the All Progressive Congress (APC) having declared him the winner of the election.

He also urged INEC to withdraw the certificate of return giving to Hon Lazarus Ogbee and candidate of the People Democratic Party (PDP) for Ezza South/IKwo federal constituency in the 2019 general elections.

Recall that Comrade Chinedu Ogah of the APC had petitioned the tribunal challenging the emergence of Hon Lazarus Ogbee of PDP in the House of Representatives elections held on February 23rd 2019.

In the suit number, EPT/EB/REP/01/2019 dated April 30, 2019, Ogah alleged gross irregularities against Ogbee, the Peoples Democratic Party candidate and the Independent National Electoral Commission.

Ogah, through his counsel, Mba Ukwueni (SAN), stated that the bone of contention was alleged alteration of election results in some areas as obtained and announced at the polling units at the collation centres.

In other words, he alleged that the result announced by INEC was different from the actual results gathered from the field and that the election was won by him.

Respondents in the matter are Hon Lazarus Ogbee a second time member Federal House of Representatives Ezza South/Ikwo constituency, PDP, INEC, Ebonyi State resident electoral commissioner, Prof Godswill Obioma, and the returning officer of Ezza South LGA Associate Prof Ikechukwu as the fifth respondent.
