A recent study has revealed the efficacy of arbitration and mediation as viable means of resolving local and international tax disputes.
According to findings, Litigation as a traditional method of resolving tax disputes while helpful tends to slow down commercial tax disputes thereby resulting in the loss of income for parties and reduction in stakeholders’ investments.
The study conducted in the Lawyard Legal Publication was conducted by a Nigerian and tax researcher, Philips Adekemi.
He analyzed the statistics by the Financial Times which revealed an increase in tax disputes by 8.5% in 2015 as against 6.4% in 2015. Thus, tax appeals and cases before Tribunals in various jurisdictions jumped by nearly 40% over the year to 310%.
The research further explores dispute resolution clauses in international tax agreements such as the Model double Taxation Agreement of the League of Nation, the Organization for Economic Development Draft Tax Convention.
