Senator Natasha’s suspension lawless, unconstitutional — Legal expert

A legal expert, Oghenejabor Ikimi, Esq, has condemned the suspension of Senator Natasha Akpoti-Uduaghan, describing it as unconstitutional and a violation of her constituents’ right to representation.

In a statement on Friday made available to our correspondent in Warri, Delta State, the fiery critic argued that the Senate had no legal authority to suspend the Kogi Central lawmaker, referencing a Court of Appeal ruling in Speaker, Bauchi State House of Assembly vs. Hon. Rifkatu Samson Danna (2017).

The ruling held that lawmakers, not being employees of the legislature, could not be suspended or have their entitlements withheld.

“The suspension of Senator Akpoti-Uduaghan is lawless and unconstitutional. No legislative house can deprive the people of their right to representation,” the statement read.

The Senate imposed the suspension under its House Rules, which allow for a 14-day suspension of erring members.

However, the critic maintained that these rules cannot override the 1999 Constitution (as amended), which guarantees her position.

“When House Rules conflict with the Constitution, the Constitution prevails,” the statement added, citing Section 1(3) of the Nigerian Constitution.

It was further noted that a Federal High Court had already granted an order overturning the suspension. The legal expert urged the Senate to act immediately.

“I call on the Senate to rescind this decision and respect the rule of law,” the statement concluded.

The Senate is yet to respond to calls for reinstatement.
