Reps condemn Umuahia ruling on Electoral Act, to seek redress

Members of the House of Representatives across the party lines, on Wednesday, kicked against the recent judgment by a Federal High Court sitting in Umuahia, for deletion of Section 84(12) of the newly amended Electoral Act 2022, signed into law by President Muhammadu Buhari.

The resolution was passed after a heated debate on the motion under matters of privilege, sponsored by Hon Sada Soli, who accused the Judiciary arm of the government of breaching the principle of separation of powers.

Recall that Justice Evelyn Anyadike, had in the judgment, held that Section 84(12) of the Act was unconstitutional, invalid, illegal, null, void and of no effect whatsoever.

To this end, Justice Anyadike ordered the Attorney General of the Federation and Minister of Justice, Abubakar Malami, to “forthwith delete the said sub-section 12 of Section 84 from the body of the Electoral Act.”

In his remarks, the Speaker, Hon Femi Gbajabiamila, who observed that President Muhammadu Buhari is expected to take legal advice on the ruling, however, vowed he won’t allow the institution (House of Representatives) which he heads to be ridiculed.
