Osun election tribunal sacks three PDP lawmakers, orders rerun in polling units

The election petition tribunal in Osun, adjudicating over the petition filed against the outcome of February 23, 2019, National Assembly election and State House of Assembly poll on Monday sacked three lawmakers on the platform of the Peoples Democratic Party (PDP).
The lawmakers affected by the judgment of the tribunal, which was headed by Justice Eyo Ita include the legislator, representing Ede North/Ede South/Egbedore/Ejigbo Federal Constituency at the House of Representatives, Hon Bamidele Salam, lawmaker, representing Obokun State Constituency in the Osun State House of Assembly, Hon Adewumi Adeyemi and Hon Babajide Kofoworola of Ede North State Constituency.
Delivering its judgment in the case filed by Hon Adejare Bello of the All Progressives Congress (APC) against the victory of Hon Bamidele Salam, the tribunal cancelled elections in seven units across four local government areas citing over voting.
It subsequently ordered rerun in the seven units because, after the cancellation of elections in units where over voting was established, the margin of victory between the winner and the petitioner, Mr Adejare Bello of All Progressives Congress (APC) was lesser than the number of registered voters in the affected units.
On the petition filed by the candidate of the APC for Obokun State Constituency during the last House of Assembly poll, Hon Bosun Oyintiloye against his counterpart in the PDP, Hon Adewumi Adeyemi, who won the election, the tribunal declared that the exercise was inconclusive.
The tribunal held that the petitioner established over voting in four units and cancelled elections in those units.
It subsequently declared the results of the poll inconclusive and ordered rerun in the units.
But, the panel, however, upheld the election of Mulikat Abiola of APC, who was returned elected as the lawmaker representing Ifelodun State Constituency.
The panel said the petitioner, Hazzim Abioye of PDP failed to prove allegations that the respondent did not resign her appointment in Michael Opara University, Umudike before contesting in the election.
Similarly, the tribunal also nullified the election of the state lawmaker representing Ede-North state constituency, Mr Babajide Kofoworola, whose victory was challenged by Daud Akinloye of the APC.
In its ruling, the tribunal declared votes recorded in 12 polling units were not in compliance with the electoral law.
It, therefore, cancelled the results of the 12 polling units and order fresh election in the units.
