The 10-year-old wedlock between a couple, Kafayat Idris and Oladayo Idris has been dissolved by Oja Oba/ Mapo Court C Customary Court, Mapo, Ibadan, Oyo State mainly as a result of childlessness.

Kafayat who approached the court for divorce stated that her mother in-law refused that she had rest of mind as a result of her barren state.

The plaintiff added that her mother in-law turned her husband against her which resulted in her husband beating her.

Kafayat in her suit appealed to the court if her prayer was answered to restrain her husband from coming to fight her in her new place of abode or work place.

The plaintiff said: “My lord, I seeking for divorce because my marriage to my husband has failed.

“My husband and I have been married for 10 years but these years have been filled with challenges because I have not been able to give him a child.

“My visits to hospitals revealed that I’m infertile while every step I took to find a lasting solution to the problem has proved abortive.

“While still battling with the reality that I might not be able to carry a baby in my womb and experience the joy of motherhood, my mother in-law turned against me. She became a thorn in the flesh.

“She turned our home upside down and refused that I had peace.  My lord, my mother in-law insisted I must leave his son’s house.

“To make real her threat, she brought into our matrimonial home another woman whom she said was my husband’s new wife. This woman I later learnt is a widow.

“My mother in-law later insisted I must move out of the house but I refused.

“My lord, she went as far as threatening to curse his son if he decided to continue with our marriage.

“I left my husband’s place for my mum after my mother in-law made life unbearable for me.

“My husband came to my mother’s place to apologise on her mother’s behalf and placate me. He begged that I should return home with him but I told him I was no longer interested in our marriage.

“He got angry when he heard that and after much argument beat me mercilessly in my mother’s presence.

“He stormed out of my mother’s residence warning me never to come near his house.

“My lord, I want to put my marriage to Oladayo behind me and move on with life. I pray that the court separate us and also restrain him from coming to harass me at my place of residence or work place.

Giving his judgment, the court president, Chief Ademola Odunade after hearing the evidence of the plaintiff and considering the fact that the defendant failed to come to court after being served two summons which according to him showed he was no more interested in their union, dissolved their marriage.

Both parties were asked to maintain peace.
