Lawyer’s ill-health stalls Justice Ademola’s trial

THE ongoing trial of Justice Adeniyi Ademola, his wife, Olabowale and Joe Agi (SAN), scheduled for continuation on Friday could not hold due to the ill-health of the counsel for the second defendant, Chief Robert Clarke (SAN).

Justice Ademola and the two others are currently facing an 18-count charge bordering on attempt to receive gratification, receiving gratification, possession of illegal firearms and ammunition before Justice Jude Okeke of the Federal Capital Territory (FCT) High Court 15, sitting at Maitama, Abuja.

At the conclusion of proceedings in the case on Thursday, Justice Okeke adjourned the case till Friday for the continuation of hearing of prosecution case.

But when the case was called on Friday, Chief Clarke (SAN) made an oral application for an adjournment due to his ill-health, saying that although he hates to use the age factor, he discovered that he was in pains and could not be able to continue with the case on Friday.

The septuagenarian senior advocate informed the court that he had sought the understanding of his other counsel in the case and therefore, solicited the indulgence of the court in granting an adjournment to a convenient date of the court.

According to Chief Clarke, “I spoke with my doctor today (Friday) and he told me it is not a life-threatening health challenge. I am sure I will be available on the adjourned date.”

The counsel for the other defendants in the case, did not raise any objection to the application made by Clarke (SAN).

On his part, the prosecution counsel, Segun Jegede, confirmed to the court that the counsel for the second defendant approached him “and basically said he could not continue with the case  today (Friday) due to poor  health reasons. Even my co-counsel, Mr Emmanuel Ubua is in the hospital as I am speaking.”

He, therefore, told the court that he had no objection to the application.

In his ruling, Justice Okeke granted the application for adjournment sought by  Chief Clarke and ordered that parties in the suit should agree on two consecutive days within the next 14 days.

Following the agreement of all parties, the matter was adjourned till 20 and 21 February for continuation of hearing of prosecution the case.
