Kano emirate tussle: Court adjourns suit till July

A Kano State High Court on Monday adjourned a case filed by the State Government to restrain the deposed Emir of Kano, Aminu Ado Bayero, and four other emirs from parading themselves as emirs.

After listening to the counsel for Emir Aminu Ado Bayero, Barr. Ibrahim Muktar, and the counsel for the plaintiffs, Attorney-General of Kano State, Speaker of the Kano State House of Assembly, and the Kano State House of Assembly, Barr. Ibrahim Isah-Wangida, the presiding judge, Amina Adamu Aliyu, adjourned the matter to July 2nd, 2024.

It will be recalled that at the last sitting on June 11th, the court ordered substituted service on the respondents, which include Alhaji Aminu Ado Bayero, Alhaji Nasiru Ado Bayero (Bichi), Dr. Ibrahim Abubakar II (Karaye), Alhaji Kabiru Muhammad-Inuwa (Rano), and Alhaji Aliyu Ibrahim-Gaya (Gaya).

Other respondents are the Inspector-General of Police (IGP), the Director of the Department of State Services (DSS), the Nigeria Security and Civil Defence Corps (NSCDC), and the Nigerian Army.

The matter was slated for hearing today for a motion on notice filed by the plaintiffs, which pertains to an interlocutory injunction following the interim order granted by the court.

However, the first defendant in the suit served the plaintiffs with a counter affidavit, to which they were supposed to reply.

Barr. Ibrahim Isah-Wangida noted that the originating summons was also ripe for hearing. He urged the court to consolidate the suit instead of addressing the motions piecemeal, so that all issues could be resolved in a timely manner, considering the nature of the matter.

Additionally, one of the counsels for Alhaji Aminu Ado Bayero, Barr. AbdulRasaq Ahmed, argued that the court should set aside the initial order as it was not properly executed according to the law.

Furthermore, they are requesting the court to discontinue the matter, as it does not have the jurisdiction to entertain the suit at the time it was filed, and to stop the perpetual order the plaintiffs are seeking to restrain Aminu Ado Bayero from parading himself as the Emir of Kano.
