Elizabeth told the Court that her husband abandoned her and the children and went after the second wife he impregnated
She informed the court that Babatunde stopped giving her money for maintenance and made her responsible for payment of their house rent.
She added that her estranged husband abandoned his family for three years.
Elizabeth told the court that her husband beats her whenever he gets drunk, adding that she was no longer in love with him.
“I can’t continue to receive the beating because I’m too young to die,” she therefore urged the court to dissolve the marriage and grant her the custody of the children for proper care.
In his response, Babatunde informed the court that it is true that he impregnated another woman but it is Elizabeth that caused it.
The 48 year old carpenter said that Elizabeth made life so difficult for him to the extent that he fell into the arms of another woman.
“I can’t believe that I will marry another woman after 11 years of my marriage, but Elizabeth pushed me to it”.
Babatunde informed the court that whenever they fought, Elizabeth would start looking for a knife or bottle to stab him.
“We fought one day that Elizabeth injured me to the extent that I was admitted in the hospital for a week. She did not come to the hospital till they discharged me.
“She did not allow me to have sex with her for almost a year and we lived together in the same house.”
He therefore said that Elizabeth forced him to go out in search of another woman. He said that he was in support of dissolution because he has another wife.
While delivering his judgment, the court president, Mr. Akin Akinniyi dissolved the 11 year-old marriage and ordered that they should go their separate ways.
He urged Babatunde to take care of his children and also be responsible for their school fees and medical expenses.
