An Agege Customary Court in Lagos State, has dissolved the union between a couple, Babatunde and Olutayo Shiwoku, over childlessness and irreconciallable differences.
The Petitioner, Olutayo, had urged the Court to dissolve her marriage to Babatunde over her inability to conceive for him. Olutayo said she wanted the divorce because of pressure from both sides of the family.
Although, the husband didn’t appear in court, he, however, sent messages through Olutayo to the court that he was in support of the divorce.
She said: “My husband and I had not been living as husband and wife now for three years.
“There’s no harmony between us. The marriage didn’t produce any fruit of the womb and family members are complaining. The lack of a child in our marriage has led to many difficulties in our lives.
“My husband also wants the dissolution of the marriage, but he said he couldn’t appear in the court. He said the court should continue with the dissolution of the marriage. I want him to know that I am no longer his wife,” she had told the court.
President of the court, Mr. Williams Philips, asked her if the family of her husband knew of her intention to divorce Babatunde, and she replied: “His family doesn’t support the union anymore.”
President of the court, Chief R.A Williams, after several adjournments neccessitated by the reponndent’s continual absence, dissolved the union, asking the couple to go their seperate ways, and also live in peace.
